Unsecured Load...Accident?

    Whats the damage to the cdl and do lawyers cost a lot for something like this?

    Move on. Company said you're cool. No inspection no CSA hit. Sounds civil. Meh.

    This should never have been on an accident report. It is a property damage report. As an officer I would tell you to fight the ticket. I would also go into the city and request to have the accident report shredded and changed to a property damage report that is not submitted to the state, DOT, or the company.

    Maybe $250 - 500. The last time I hired one was $500 , but it was Ontario, CA. You don't want your record show "unsecured load" ticket for a prospective employer or their insurance, if you ever consider to change an employer. Better have something like "illegal parking" or a "nonworking headlight", or best dismiss it. Maybe they could claim that it was not your fault. I would at least get a consultation. The consultations for something like that should be free.

    I would definitely take that to court.

    Lawyer wouldnt hurt,.. but if your local I would go in an just plead not guilty. Explain what happened and that your load was clearly not unsecured. That it was an improperly written ticket.

    Chances are the judge will dismiss that on the spot. If he doesnt or wants to fine you,.. ask for a continuance and hire an attorney. It shouldnt be more than $150 - $250 for a lawyer to plead that out with the state and get it dismissed.

    Its not the fine you want to worry about. Its the points on your CSA and MVR that you need to keep off your record. Did they write you a civil ticket or DOT ticket? If civil I'm not sure it will even show up on your CSA, but 5 pts on your MVR is just as damaging and insurance companies will freak out over something like unsecured load,.. even though it wasnt.

    Thats just me. I fight everything and I rarely ever need to show up in court. Lawyer usually gets it dismissed with out needing a court date.

    a long time ago I had a fancy looking red foreign car with a 4 cylinder single carburetor engine with about 90 HP. had a vacum leak and sputtered when you first started out

    I gassed it when the light turned green and drove 1/8th of a mile to the next light and freeway onramp.

    As luck would have it a stater cop saw me and pulled me over at the merge lane onto the freeway, claiming I was doing 60 in a 45 zone. I told him there was no way my car could do what he claimed ( it really could not).

    He said well you are on the freeway now so I will write you for 60 in a 55 so it wont cost you as much.

    Went to court, told the judge what happened and the judge dismissed the charges after asking the stater if what I said was true.

    moral of the story, if the cop wrote you up for something you did not do, they can not swear in court that the ticket represents the true facts. One of those catch 22 things.

    Welcome to the worst system of justice the world has ever seen. You're an idiot if you plead guilty, course it'll cost you $5,700 to take it in front of a jury but there's nothing else you can do this will ruin you

    Thanks a lot that's exactly what I needed to know. It was a ticket from a city cop not Dot by the way.

    Btw since they wrote me a accident report does this count as an accident on my record even though I wasn't actually driving and didn't hit anything?
