This. you can't omit an employer ini this line of work. just tell them you abuse legal buds, bath salts or vicodin. none of that shows up on a DOT drug test. the marijuana places swift at a legal liability. so when some idiot crashes into you because he's drunk and high on heroin, and kills himself, the lawyers are gonna subpoena your DOT physical card. Guess who is liable for employing a "known substance abuser"? Dude I used to smoke weed all day every day, I was completely high for 6 years straight before I got my life together. Do I tell people this? No. It's not their business, and it's not your business either, except I just told you...haha. also, legal disclaimer: i used to only smoke "legal buds," bath salts, and abused vicodin. that marijuana stuff was terrifying, addictive, and made me want to kill innocent people with a dull axe.

the key word is "innocent" people. that marijuana is a weed with it's roots in hell, it will turn the straight man into a homosexual, a homosexual into a bisexual meth-smoking zoophile, a zoophile into an incestuous republican, an incestuous republican into a democrat, and a democrat into a low-functioning schizophrenic heroin addict with delusions and auditory hallucinations. I became all of the above, and that was only after using marijuana one time. At the end of that single-use of marijuana, the effects were so strong and unpredictable, I committed suicide. yeah, its that powerful of a substance.

Don't believe me? try it for yourself ,and experience the life-ruining consequences. the first time i got high on it, i stabbed my very own face off with a serrated piece of tempered glass, and began screaming about incoherent things. the LAPD eventually tazed me 34 times before beating me with their clubs and batons, which sparked a horrific riot back in April of 1992.

...jesus christ, I think my drug abuse caused the los angeles riots. Am I rodney King? I don't even remember who I am, thanks Marijuana, thanks for ruining my life and my mind, and my memory. because of my drug problem, my wife is now screwing some financially-secure Dentist. JUST SAY NO

Is this physical on my record or can I go somewhere else and pay for another one and not mention the weed and be good?

I don't know if the DOT physical is on a nationwide data base or not.
Does CR England do hair follicle test? Someone posted they do now; maybe they were joking just trying to scare people off; I don't know. I'd find out for sure before going there.
CRST only does urine test. You can take your own long form DOT physical there and all they do is a urine drug test.
I'd get a fresh physical and start over. Some chiropractors and also CVS Pharmacy does DOT physicals.

It's on record as your own personal medical records at that occupational medicine doctor. you can probably get away with hiding this physical, by taking a new physical at your own expense. you could then probably get away with omitting the marijuana use and then file that new, updated DOT medical certificate with DMV.

I should also like to add, that nobody will ever know you took that particular marijuana-admission DOT physical, unless you actually took the medical card, and filed it with DMV yourself, to update your medical clearance.

Therefore, I believe that even the knowledge of that prior physical--where you admitted to using marijuana--I think it would only exist, insofar that someone else already had knowledge of your admissions of marijuana, and wanted to like, subpoena that specific medical exam. That's a huge burden, and likely never to surface unless you're in a wrongful death lawsuit.

Basically, if that is not the medical card on file at DMV, it never happened. It is not accessible by other employers; HIPPA protects your medical information, with the exception that it may be accessed by the company paying for the physical, and offering you employment.

if you haven't yet filed it with DMV, don't file it. Go get another physical, and don't say anything about weed. Pass your new physical, and file that one with DMV. The prior one with marijuana use, should be protected under HIPPA laws of medical privacy. No other company will have access to it; they won't even know you had that physical. The only way any future company will have knowledge of that prior physical where you admitted marijuana use, is if it's on file at DMV.

The main kicker; make sure you're at a different clinic, using a different doctor.

Again, I'm not advising you to lie or commit fraud. Rather, I'm informing you of your right to medical privacy. Did you actually smoke weed? How do you know , you were smoking weed, when you actually think you smoked it? You have anything that proves you were smoking weed 4.5 months ago--like a failed drug test result? What's that, you said you CAN'T prove you were actually smoking weed 4.5 months ago? Why didn't you say so. It was probably oregano. You do understand what I am saying, right? Without objective proof, it didn't happen.

You gotta be smart dude. A carrier could give a #### if you burn marijuana all day every day. They don't want a record of it, and they don't want someone who tests positive for insurance reasons. The liability is such that they will always lose in court, if records exist showing they knew you used marijuana. The key operative; "if records exist showing THEY KNEW YOU USED marijuana." "they knew" being the key words here. If they don't know, they don't care.

I should also add this. A smart safety manager doesn't want someone who is "too honest." You'll be the first one to say, "I'm sorry," when some idiot crashes into your truck. In this line of work, even when the evidence is in your favor, an apology is always an admission of guilt and liability. Just say NO. THAT DOESN'T MEAN YOU CAN'T DO IT. It just means, don't admit it. Don't get caught.
