Sorry this is a business, not a family thing, he is a huge liability to the owner and the company and especially with the public safety with something like this, firing him is the only thing to do to mitigate the risks he presents to the public and the company.
Charging for unearned hometime??? Driver late and I'm getting charged.

First off. I'm not defending the driver. As l said before the fact that he has been late repeatedly is probably enough grounds for dismissal. Since he goes home his day is done. Period. He can drink a beer if he likes. He's not in a vehicle. If he starts work under the influence than he should be fired. But to prove it send him for a random test first thing in the morning when he reports for duty . Other than that its heresay.Bean Jr. Thanks this.

Not true. As long as the driver stopped drinking 4 hours before performing any safety sensitive work and had a BAC of less than 0.04, he's within the regs:
§382.201 Alcohol concentration.
No driver shall report for duty or remain on duty requiring the performance of safety-sensitive functions while having an alcohol concentration of 0.04 or greater. No employer having knowledge that a driver has an alcohol concentration of 0.04 or greater shall permit the driver to perform or continue to perform safety-sensitive functions.
§382.205 On-duty use.
No driver shall use alcohol while performing safety-sensitive functions. No employer having actual knowledge that a driver is using alcohol while performing safety-sensitive functions shall permit the driver to perform or continue to perform safety-sensitive functions.
§382.207 Pre-duty use.
No driver shall perform safety-sensitive functions within four hours after using alcohol. No employer having actual knowledge that a driver has used alcohol within four hours shall permit a driver to perform or continue to perform safety-sensitive functions.Tug Toy Thanks this. -
He's doing his drinking at home and taking a few extra hours on his 10 so he is playing it safe but every time he's late I get stuck with a $800 service failure and it's just starting to become a bit too much. As for why I'm not willing to get rid of him yet is because he lives in the perfect spot for this lane and he is FedEx C/C qualified so it's not like I can just get another guy to put in that truck.

Must be lucrative if you can peel $800 off the top every load and eat it bc "it's hard to find good help"
