Hit by drunk driver tonight

    Hello, I was just involved in an accident with a drunk driver.

    I was NOT in my truck. I was in my personal vehicle on summer vacation, Driving on the beach. Was hit head-on, the other driver admitted full fault to me due to his condition. However before the cops arrived, the other drivers girlfriend arrived on the scene and started dispensing legal advice to the other guy. He refused the breathalyzer and was arrested. I was not ticketed or cited in any way.

    I'm not sure if he will be convicted, and any trial may take years.

    How badly will this affect my employability? I was hoping to move on from my starter company after my vacation.

    It shouldn't affect you at all, especially if you weren't at fault in any way.

    My main concern is that this was on a beach. Primitive driving conditions with no clear travel lanes. Worse case scenario is he fights the charge and either him or the insurance companies try to pin some blame on me.

    The other drivers girlfriend gave very poor advice; he refused a breathalyzer which is just as bad as pleading guilty to DUI. The guy was drunk! I'd talk to a lawyer right now about this. He may want to file a lawsuit first about that whiplash you got.

    I was injured in the accident. Possible broken limb, going to doctors later today. Officer said by refusing breathalyzer, he may avoid intoxicated assault charge and instead choose to accept "administrative penalties" for refusing breathalyzer.

    If you were injured, have them call the ambulance to take you to the hospital and get the ball rolling on a law suit.

    While he can refuse to take a test, that doesn't mean he can't be charged with it, and you not making a big deal out of being injured, let's him get away with it by not having a prosecutor getting a warrant and having a blood test done.

    Depending on what state,the refusal will buy some time for the bac to come down. In North Carolina the cop will call in for a warrant to draw blood on the way to the hospital.

    Who's going to hire someone irresponsible enough to let a drunk driver hit him? LOL. LOL. LOL.

    That doesn't work either.

    They'll just simply extrapolate what one's BAC was at the time they were stopped based on about .01% an hour.

    You didn't get a ticket so you shouldn't have a problem with future employment. Insurance can fight all they want but they can't make a report to your mvr. You got nothing to worry about.

    Keep your police report though, just in case something does come back to bite you.
