Sleeper berth is a part of on duty, so you can legally log it.

    ###### boy! That's pretty good. I'm only doing about $14k a month cause I've been taking about 10 days a month off.

Sleeper is off duty. You're not performing any on duty. You're sleeping.

Nope: driving, on duty, and sleeper berth are all considered on duty time; off duty is when you are 100% relieved of any duty status and responsibility...

So when you're on line 2 it counts against your 70? Cause ALL on duty time goes against your 70.

Grew up in industry and career in it...now when you are logged in sleeper you are still responsible for the equipment and load...sleeper berth is considered a part of on duty time where as you are taking a mandatory 10 hour break...or taking break while being loaded/unloaded at shipper or receiver. You are not relieved of duty when in sleeper..so if you technically look at it you are an unpaid security guard....that is reason why wal mart pays their drivers for sleeping in the truck.

In reality, it's not on duty but it's not off duty either. You are still responsible for the load but you're not using your time. Actual on duty time counts against your 70 . Actual off duty time means you are relieved of duty.

I just log line 1 do I don't have to worry about this mess because I am totally relieved of duty while I'm on a break. Yes, you can be relieved of duty while being loaded. Plus, if you log line 2 you better spend all that time in the sleeper or you're in violation.
