Ticket for 15 over in personal vehicle.

    Attorneys are VERY worth it. I recently won a "speed trophy" from some of Ohio's finest, and a $250 legal fee made the points go away, and no moving violation.

    He literally just finished orientation Friday and is supposed to meet his trainer Monday. The lady over his orientation never mentioned that policy, what should he do at this point?

    It is 24 hours from getting the ticket, or 24 hours from conviction? That's the first thing to find out. If it's from the conviction hold off until it's pled down.
    Hopefully he has the handbook still and it can be looked up without having to sk the office.

    Lawyer are always the way to go! I got hit for speeding in a construction zone (3x the normal penalty) and the guy got it down to 3 over. Save me lots of grief as I was getting ready to start a new job.

    He hasn't been convicted of anything yet. I wouldn't tell Schneider of anything until traffic court is complete.If he tells Schneider right now, he'll be unemployed a few minutes later. Schneider is really strict on reckless driving tickets and that's what that is.

    in my personal vehicle-not their truck-i wouldn't tell them anything. they probably won't see it until they pull his yearly record if at all.

    I've spoken to a dozen drivers this evening and they all said eff telling Schneider until it's resolved in court. By law, it's innocent until proven guilty and the ticket isn't even on his record until he either 1) pays the original ticket admitting guilt of 15+ over or 2) pays the reduced ticket of 4 over. He then would have 30 days to notify them of a conviction. It's also pretty crappy that he wasn't notified of this policy even once during orientation, he wasn't even sent home a handbook just the book of homework that doesn't say anything about the violation policy.

    Negatory! The FMCSA only require notifying your employer of CONVICTIONS within a specified time frame (30 days, if I'm remembering correctly without looking it up). You do NOT have to tell them about the ticket right now. If your lawyer gets it knocked down to 4 mph over, THAT is what you report to the company AFTER the conviction. If you fight the ticket and beat it, the company never needs to know because you were not convicted.

    If you tell them you were written for 15 over, they'll likely fire you before you have a chance to fight it in court. Wait until the court finalizes whatever deal you can get...then report the outcome of that to the company. They won't likely fire you for 4 over...and if that's what you can get it knocked down to, that is ALL the company needs to know.
