Using temp drivers

    Yeah you can't legally do this unless you are running the trucks locally, then depending on the state, you may just 1099 them as a contractor.

    The easier way would be to hire out the driver and truck.

    Wow, so many bad answers in this thread, some from folks that usually are spot on.

    Yes, a motor carrier can use another motor carrier's drivers, no you do not have to drug test them, or even have a driver qualification file as long as the carrier you are borrowing them from does. You would pay that carrier and they would pay their drivers, their worker comp would cover them as well

    We did this all the time in the oil field, I still lease drivers out to other car haul and towing companies on a regular basis. Just make sure your insurance policy allows for temp drivers without them running their mvr, otherwise the carrier you are leasing the drivers from will end up liable for any accidents.

    This is trip leasing drivers, and as long as the period is less than 30 consecutive days you are generally exempt from qualification and record keeping requirements. See the following sections of the FMCSRs for more details:

    Not sure if it was legal,but...our ltl company would "farm us out to other companies",no files,drug test nothing.Showed up in our insured trucks,and paid by our company.Pulled their loaded trailer.Still had our permits.Who knew?

    You were probably being leased out. That happens around here. Although we bring our own equipment. it's not uncommon to need extra trucks occasionally.

    Ive gone to work for anyone who would pay me. I just maintained a logbook with that person's carrier name and location of truck's home base. I did not care if I worked 4 hours or 4 months as a temp loaned to another. It was actually a good mark in my book to help someone in need and my regular boss thought enough for me to get sent to go temp a bit.

    As long you as a driver have the correct CDL etc, and the tractor trailer you are given has also the correct papers there is no problem with legalities.

    I do distinctly one truck that did not have insurance or alcohol permit for seagrams of baltimore from the port nor did it have the current bingo for two states. I refused that job. They fired me. But you move on. You don't argue against a stubborn stupid multi million dollar company too dumb to spend 100 dollars for these simple little papers and stickers easily acquired in a day or so.

    IHear ya...I would have ditched them too..Ok ,its time to move on.This is what they say at my company mow...Since,they keep postponing raises....Ok Cmon its literallly been 2 yearsand 6 months since Anyone Seen A Raise? WTF.Anyway...When people QUIT ITS THE OLE "TIME TO MOVE ON EXCUSE". IM JUST ABOUT READY TO "SQUARE OFF AT EM,WHERES MY RAISE,IM 4 RAISES.BEHIND MOFO!!.WHY DO I PUT UP WITH THIS BS.I really dont know?
