I have a unique, checkered past. Is my OTR career over before it begins?

    Employers are not allowed to ask about or make a hiring decision based on deferred adjudications or expunged records. There are a few exceptions to this rule but I don't think truck driving jobs is one of them.

    When a record has been expunged you can 'Legally' say it never happened.

    Since it's been so long ago, I don't think you worry about it that much. There will definitely that will take you. These big companies are self insured, they will give you the experience.

    I personally would have just kept hush hush about it seeing it was so long ago. Not like you're trying to get into the FBI or something.

    since this happened when you were 17, you may have still be considered a juvi?

    your case may be sealed by the courts?

    if so, you may never have to mention anything at all?

    We all for the most part have done really stupid things when we were young.a lot of us were lucky and nothing happened and didn't have to pay the price for it.Some not and deal with it however they do.But if it's on a criminal report or mvr it would I guess it would depend how far back the company did la search.for me I think I would just tell them about it just to not stress over it.But at the end of the day it's just a job if it didn't work out you'll find someone else

    spobuggie, you were still a minor when this happened, and you had a deferred judgement and fulfilled the requirements. You were never convicted of anything.

    If someone is asking about things that are off the record or out of the record, just tell them no.
    They have no right to ask in the first place and are only trying to find dirt in your past to use against you.
    If it does not show up on their background check, it does not exist for anyone.

    I would like to know why it came up in the first place? Do they have an application requiring your last 27 years driving history? Most companies only look at three year citations and accidents, five years at the most, and seven years for DUI. Ten years work history.

    Actually most job apps I've done asks for 10 years,15 years, or ANY felony. So, of course, answer truthfully. I honestly have never seen a job app ask for probation, or deferred adjudication. I thought it was illegal, but I just did some googling, as it seems that in most states it is not illegal to ask.
    I would still say not to worry about it. That it would be the exception and not the rule for a company to ask about it.
