Exaclty, but my point is your violation would be on line 3. When you drove past your 14 window. That's what I'm saying the only line I know of you can have a violation on would be line 3 driving. The only way to violate 11 rule is by driving, only way to violate 14hr rule is driving and the only way to violate 70hr rule is driving. Correct?
70 hour question.

Yes you are correct!
You are correct.
If you
Drive more than 11 hours you are in violation of the 11 hour rule.
Drive passed the 14th hour you are in violation of the 14 hour rule.
Drive passed the 60/70 hour you are in violation
YOu can be on line 4 passed the 11,14 or 60/70 hour rule.
On the 70 hour though you are basically borrowing anything over 70 from tomorrows hours.
But in a nut shell yes easy way to look at it.psanderson Thanks this. -
Correct!
your 14 hour clock started # 5:00 am and ends # 7:00 pm. You wasted 7 hours sitting at the dock. So you only have 7 hours left to work/drive.
So drive 7 hours then do your post-trip/fuel etc and then take a 10 hour break.
If you DRIVE passed 7:00 pm you are in violation going back to his statement the way to violate is to drive passed the 11,14 or 60/70 hr.psanderson Thanks this. -
Thats the way that works best for me, i figure why over complicate it.
-
Yes. Very good way to look at it! I like that idea. Thanks!

You are correct. The violations of 395.3 occur when you were driving more than 11, driving after 14, or driving after 70. All are violations because of what was entered on line 3 assuming you had a legal rest period (10 straight or split rest) prior to driving on the next work period. If you failed to have a legal rest period the 11 hour violation would begin at the point in time you were driving again assuming you had driven 11 on the previous work period. The 14 and 60/70 would be violated at the point in time you were driving once those time frames were reachedDBL_TIME Thanks this.

Actually you don't want to look at the 11 & 14 hr rule in a day figure of speech.
If I have a fresh 10 hour break (or more) and I start working # 12:00 am and I do 15 minutes on line 4 then drive 11 hours and log 15 minutes on line 4 and then take a 10 hour break. I can drive again that same day.
My total driving time will be more than 11
My total driving & on-duty can be more than 14
You just can't drive more than 11 hours in a 14 hour period. Once you take a 10 that rule is reset to a new 11 & 14.
Many drivers think the total line 3 should not be more than 11 (not true) however it will get an officer to look at your logs a little closer but if you did it right you are ok!
Now if your line 3 total is 12 and you did that 12 hours without a 10 hour break somewhere between that 12 then you are in violation.
I like to clarify that. We also have drivers thinking that it's midnight and that means a new day so I can drive 11 hours even though he just got done driving 11 hours prior to midnight. Really they get confused by looking at the 11 & 14 hour rule by the day as the 14 hour period rule.
Grr I hope that made sense but I am sure Anderson will correct me.psanderson and DBL_TIME Thank this. -
LOGSRUS is correct above. The 11 & 14-hour rules are figured from the end of your last legal rest period. If you drove for 11, and only took 9-hours rest you will be in violation of the 11-hour rule once you have begun to drive again. Same thing with the 14-hour rule

Yeah good point and maybe I will use that way of expressing it when training that driver I just can't get the point across to.
I still have drivers that won't log line 4 passed their 11,14 or 70 because they don't believe me and they won't take the time to read the book, their loss though, not mine

As far as the working past the 14 hour rule.....keep in mind that some companies have stricter requirements. IE...Schneider has a policy that you aren't allowed to even be on duty not driving past the 14 hour mark.
