You could not. My sleep 6 hours is a teenager's 14 hour lolling in the palace of light as the parents kick him out of his funky bed to attend afternoon classes at the high school. (So they wont get hauled to jail for raising a truant....)
I advocate a form of complete freedom. If you want to impose a 12 hour limit on driving? Fine. But leave the rest of the clock after the driving is done alone. With the idea that you only need 8 hours to complete a rest period before you do another 12 hours of driving.
Use FEDERAL wages per hour that is prevailing nationally. Be it 15 dollars or 20 or 30 or whatever it may be. That Log book becomes payroll time card. 12 hours to drive provided you had 8 hours off at home or in the sleeper berth, with no silly optional, mandatory or other rest breaks. On duty hours is already acknowledge to have no limits except one. You must have 8 hours before you drive 12 hours again.
Actually I just solved the wage problem.... The highest speed lawful limit for a 18 wheeler non governed is 85 mph, currently in south texas among other places on our Interstate system. If a big truck is able to cover 85 miles in a period of one working hour driving down the interstate.... then presume a working wage of .50 cents a mile which will be paid to anyone generally fresh from school, orientation and with a trainer for a period of time. Thus 85 miles times .50 = 42.50 per hour wages to be paid in whatever the log book says for time worked that day.
Thus a 12 hour shift at 42.50 a standard wage hour Grosses 510 dollars to one driver. I will expect no complains,no conspiracy theories and none of that sillyness. Two drivers in a team would make 1020 flat to the truck every 24 hour working day.
Because you hold a CDL, honored and recognized in all 50 states, canada and mexico... then your wage will be 42.50 a hour without discussing or other complications. The employer does have the option of increasing additional moneys to pay as a reward for well done work or benefits etc. But that Professional CDL holder WILL earn a base pay of 42.50 per hour driving. It cannot be reduce or changed by anyone engaged in shipping and recieving or transporting freight.
I hope to god your freighting pays quite a bit of money to make this worth while. That means hauling QUALITY NEEDFUL freight that is very important and never out to the United States and our entire Nation's Commerce, Industry, military and so forth. We aint hauling or schlepping dollar store crap (No offense here...) IF that means Amazon ships 10,000 little packages to dollar store in Searcy for the staff workers to open and inventory and stock the product, so be it. No more fooling around with a 18 wheeler.
Exempt shippers and recievers from enforcing adverse actions via private property against truckers engaged in commerce. We are not bums seeking to shop lift a pack of smokes at the gas station or sell pills behind the building or something else. That way the trucker knows he or she can get some rest then and there before moving down the highway. If a tow vehicle is called incident to being kicking a tired trucker and his rig off the property, then shipper bears the cost of that tow away.
I can go on. But this is a seed. I want to see ideas from the rest of you. You have a scenario here to build a proper HOS frame work or none at all. How do YOU want this law to be written???Last edited: Oct 26, 2017
