I have been safe professional over the road driver for 15 years with no real bad record...got a couple of weight scale tickets.....one of which was a "failure to stop for light" in a BYPASS lane..who the hell puts a light in a BYPASS lane???
Anyway i got cited at 3 am about 1 1/2 months ago going up Hwy 1 in Indiana from Hagerstown...the limit is 55 mph...the time is 3 in the morning so it is dark and i am the only one out there...no other traffic anywhere.. Winding farm roads are risky even at night..so my top speed at best is 57...out of nowehere the sky lights up blue and red..i double check my mrrors and there is a town cop behind me..i pull over not knowing if he was pulling me over or needed to get by...he gets out and i am cordial and say Good Morning...he tells me he clocked me going pretty fast...i asked how fast he said 70 mph...I was like Wow..really? he said Yep...and yu "swerved" in your lane there...i was like Ok..you idn't see the deer on the roadside facing the road...i moved over to avoid startling it in jumping out in front of me...so he goes back to his car and i wait...and wait...2 other officers cars show up and they sit back there BS'ing or whatever...meanwhile my dog has to go to the bathroom..so i lease him up and get out and take him around the front of the truck ..he goes and i go to put him back in the truck...at this point a younger officer approaches about 1/2 down the trailer with his hand on his gun...I said don't worry..dog's just going to the bathroom..i put the dog in and get in..he approaches and says.."How many times have you been told to stay in the truck?" I'm like "What?" I just let my dog out while you guys are back there talking...He says...yoyu've been told 3 times to stay in your truck...you get out again and you're going to jail....Im like WHAT???..Dude i have not gotten out to do anything exceot let my dog out for potty...He's like I don't give a ####...get out again and youre going to jail...Oh boy was I mad...and i don't get mad easily...
The inital officer that stopped me comes back and hands me a ticket and tells me i can call and pay the town court over the phone...and i inquiried as to his "partners" rude behavior...he said it is their responsibility to keep us safe when they have us stopped at roadside..I'm like there is NO OTHER traffic here...its 3am...noone is out here...He says to have a nice night...i drive on...
Call into the courthouse to find out what my options are a couple of days later...basically its pay the fine or appear in court...so i said i can't appear in court i don't live in Indiana...well then just pay the fine....but i am not guilty the truck only goes 65 mph..he said i was going 70....OK hang on...what was the officers name...i told them...the citation number...i told them...then i said i want to plead not guilty in wiriting...well they said it's not going on your record so why not just pay the fine...I asked what happened if i just didn't pay the fine...they said license suspended...
So i call the NC DMV...tell them the situation...not only do i have my license susspended but i pay the fine AND an extra $100 to get my license reinstated...to which there is the mark of suspension on my record...so i figure..ok just pay the #### fine..they said its not going on record...i notify the copany i am leased with over the whole thing and ask their advice...they look up and say well it's not on your record...OK good..so can i contest this through the company's legal dept or what? No..just pay the fine..you'll be OK...2 weeks later...i am fired...for what...the ticket....i go home and think ok..i'll get a local driving job...no problem..apply with a local outfit i use to rin for for about 4 months...sure they'd love to hire me back...but uh oh...there's a 25 mph over the limit on my record...WHAT???..Yep nothing you can do for 5 years...I call TVC to see if there is anything they can do..they set me up with an attorney in the county of Indiana where the citation was done...consulted over the phone...NOTHING CAN BE DONE...had 30 days to appeal...wait a minute..it says 90 days on the citation...nope..30 days...sorry nothing we can do...
So here i sit..screwed blue and not tattooed....all over a LIE...my career is finished....nothing i can say do or think short of....

My first thought is to seek actual legal help instead of those TVC jokers.
Bad situation indeed.
Start collecting all the data you can to build your case. If you have anything like dash cam footage that shows your speed I'm sure it'd be helpful as well.stwik, x1Heavy, Dave_in_AZ and 1 other person Thank this. -
Why did you not ask to see the radar? Especially if you knew what speed you were traveling at. Your story is terrifying, but I bet this happens more often than we know. Crazy.

Dude it has been a month...my dashcam was built into my lease truck which has been repo'd by DART i could not bring it home with me.. i got a local ####ty fiberglass plant job for about 1 month left ...the plant is closing and i know nothing else to do..

A better question is why the cops were camping that spot at 3am. It certainly wasn't to make everyone safer. Nope it was to catch someone on a ######## technicality for a massive fine to help fund the local township. You know... Extortion.
Why is every effort made to excuse any action by Law Enforcement no matter how unreasonable, but the citizen they are interacting with had better have PERFECT behavior or the incredibly out of proportion punishment the cop feels like at that moment is totally justified.FitTruckerATL, x1Heavy, mjd4277 and 8 others Thank this. -
I have to agree there. You don’t just get out of the vehicle during a traffic stop. Engine off, dome light on, hands on steering wheel and mouth shut until spoken to.

I'll agree it could have been handled better by OP. At the same time I don't expect the average person to handle themselves perfectly in a high stress situation that they weren't in any way prepared for mentally.dunchues Thanks this.

Are you serious. Prepared for mentally? It’s a traffic stop. Shut up, stay in your vehicle. What is there to prepare for? I bet waiting in line for fuel would be terrifying.
