Im curious if any of you know anybody who has moved their company, or started a division of, in the US? Im seriously considering it and with the L1 Visa explanation, I can do that, or I can completely shut down my CDN operation and go with an E2 Visa and re-establish my company there.
For those of you who have any insight on this, I'd be greatful to know how the process is handled and what sort of timeline there is.

Why is it that nobody can answer the original question? Why does my reasons for doing it have anything to do with what I asked? I am conservative, and sometimes conservatives will do what it takes to get what they want instead of lying around whining.

I was leased on with a carrier that opened a U.S. division, although I can't help you with the time line or cost. Their reasoning was, ironically, to skip out on FMCSA fines. They set up a new Montana-based carrier and then trip-leased their's and leased-on trucks from the Canadian entity which had its authority suspended.
A couple of points though; I would think that it wouldn't be worth it to operate in both countries unless you are making fairly significant revenue and there is some specific savings or advantage to be had. In the aforementioned case, it was a way to keep the 15-20 trucks working, but much smaller and I suspect the costs would have outweighed the benefit.
Another part of that is that if your intention is to retain residence or other ties to Canada, you will want to get a very thorough analysis from an experienced international tax specialist. The U.S. has really tightened up their tax rules and you really don't want to run afoul of the IRS. You can end up in a double-taxation scenario which you really want to avoid.
So, as far as timeline and cost, I think it's going to be longer and more expensive that you think right now. And, as someone who has advised people on such moves in the past, you REALLY, don't want to take any shortcuts.Oxbow and CaboverKid Thank this. -
I will be speaking to a tax lawyer and also an immigration lawyer this week. I will get all these details sorted out. I can easily keep an operation going on both sides, but we will see whats the best route to go on this.
