1( not infringing on any of my rights.
2( I don't see how it's going beyond acceptable limits by having it done electronically instead of paper.( forcing compliance).

I believe this to be a sincere question. I'll do my best to provide a reasonable answer.

The people who are generally responsible for regulating the transportation industry know next to nothing of the day to day workings of the very industry they go about regulating. On the other hand, those entities who ultimately control the regulators through their powerful lobbies and special interests happen to know the industry very well. Nearly all regulation is agenda driven. In pushing regulations upon any industry, emotion is a very useful tool. No one wants one of their loved ones run down by a tired trucker, enter MATT, or mothers against tired truckers. But what they don't tell you, is who finances groups like MATT. in their particular case, it was the railroad industry, for reasons that should be obvious. So who was it that pushed so heavily for the ELD? Well, it was the MEGA's, for reasons that should also be obvious.

In my view, most all regulations are some form of an encroachment. If yesterday I was a law abiding citizen, doing no harm to my neighbor by my actions, and with the stroke of a pen, today I have been deemed a criminal by my lack of action, or compliance, there has been an encroachment upon my liberty.

There are sufficient laws to prosecute one for harming his neighbor. If you fall asleep at the wheel and kill my family you will be prosecuted, if no sufficient evidence is produced to convict you, I still have civil court to pursue damages. Simply put, in my view, if no one has been injured either fiscally or physically than no crime has been committed.

Regulations create crimes where prior to their enactment no crime was being committed. This is an encroachment on liberty. In the particular case of ELD's, it is an encroachment on an individuals or corporate entity's ability to engage in commerce. Worse, it is an encroachment that is weighted heavily to the exclusive benefit of a particular group of entities. It is an unfair advantage given to one group over another under the cover of law. Almost all laws that come forth from Washington have this motivation behind them. Cui Bono? If you ask this question regarding practically any regulation passed in the last hundred years you will begin to understand the meaning of encroachment.

    I disagree with your explanation.
There is no encroachment to ones liberty's
You are still free to do as you please
    I disagree with your explanation.
The mandate isn't encroaching on ones liberty's, you are still free to do as you please. I'm guessing you were going for the oppressive restrictions by authority on ones way of life , behavior ect.

Its also not stopping anyone or corporation from engaging in commerce.

Creating crimes ? Because of a regulations not there prior to. So not running in compliance wasn't a crime prior to the ELD mandate?

And where or who has an advantage over another now that most everyone must run within HOS.

    Crap it's bedtime cya.

I have nothing else to add on this topic, except that the HOS were an encroachment already, before ELD's.

May I suggest a book or three.

    The Road to Serfdom

and if those are a bit too heavy, perhaps

    really? give me a break....
people think red light cameras are also encroachment. but that doesn't mean they think stop signs should be ignored too. nor does it mean those same people are running red lights all the time. but according to the logic above it does.

the encroachment didn't start with ELD.
government always jams its foot in the door under the guise of good ideas. go talk to a liberal about how great gun confiscation would be for "safety".

just because you're fine with it doesn't mean it isnt what it is. nor do i care to argue with someone so indoctrinated about something. there's people out there that don't think Bashaar al Asaad is a dictator. i'm not gonna think i need to explain why he is to their satisfaction.

as far as tucker is concerned he's been on here for months acting like anyone that isn't tickled over this needs to be arrested over public safety concerns but dismisses guys looking for work arounds on the eld as people just being human and a locust(?).

great. so you go be human with your eld and i'll go be human on paper. i'm not driving thru the parking lots at 4mph. you don't see me on here asking if i can log leaving the shipper and going to the truckstop as Personal conveyance i actually LOG that on my paper log. i LOG every mile i drive unless i'm wearing my "mechanics uniform". since tucker can freely admit everyone is just gonna work around this idiotic ruling anyways why so wounded about the guys that don't want it?

i really don't care if someone likes eld or not. use them for all i care. i have a problem being told i have to use them. i find it hypocritical when someone who accuses me or others of being illegal, uses any kind of work around on their eld. whether locust or not.

just in case some of you forgot,i'm actually a person that lives here, pays taxes and all that fun stuff. i drive on these roads in my car too. whatever "risks" you think there with these "outlaws" out here running paper,i'm subjected to them too,and i wasn't rolling down the road in fear then, nor do i have a sense of relief now.

that's the difference between guys like me and guys like tucker. even with the exposure to all this danger,i'd still let guys run the way they feel they run best. if it were up to me i'd run everyone under the old HOS where a guy can take a nap every few hours if thats how he feels his strongest. what do i care,he lives in that truck for days on end?

tucker will have you run on a daily schedule determined by government, and forced to comply via electronics.

thats not being a locust tucker. thats being cattle.

i'd sure as hell rather have a guy like wore out and his 27 year old iron rolling alongside my car on the interstate rather than a swift truck with all the safety bells and whistles and collision avoidance and so on and his eld letting him know he's safe to drive.

give me break, you eld pom wavers are ridiculous.

You've certainly made some very valid points about this ELD issue, IMO, but we should also remember this is a moving target that is likely to change over the next year. I'm not a fan of Big Government, especially when it's going down a socialist path as it was under President Obama, but we need to get active and push for change in things we don't like.

We live in the USA, not a communist dictatorship, so we have the right to voice our concerns and help institute change. I don't mind using the ELD, but some of the folks on here have IMO raised some very valid concerns that will only be addressed IF people speak up and take action... which might warrant creating a similar thread over in the politics section of this site.
