I couldn't agree with you more.
But what Big truck truck driver can afford to press the issue in a court of law --- probably for years --- to recover what's owed to them?
It'll be dragged out, attorney fees, court appearances, etc. etc.
Meanwhile, the damages are still there. And to fix the damages, the trucker will be required to pay the bill in order to have what they need (their Big truck) to make a living. Sure can't let the Big truck sit until the courts iron out all the legal mumbo-jumbo.
Who wins in the end?
Especially if the business goes belly up.
I'm thinkin' many folks just chalk it up to a bad experience and learn from it. So, whereas the legalities of Not Responsible For Damages may not be entirely legal, it might serve it's purpose anyway by dissuading some folks from pursuing the matter. And some folks might believe the fine print, cut bait and count their losses.
If it were me, I'd take the matter to Judge Judy.

It's easy to get a truck driver by the short hairs in that regard, being nomadic such as they are and trying to make all the court dates --- or pay an attorney to appear for them.
He needs his Big truck, so he foots the bill to get 'er running, and hopes for a speedy recovery --- which may never come.

Shock you are right. I ended up doing exactly what you said, just got the truck rolling. With freight as low as it is right now things are hard enough, so I ended up biting the bullet and paying for the repairs myself. At this point all I can hope is that somehow someday they get theirs!!!
