When are tests administered?
DOT drug and alcohol tests include:
- Pre-employment – An employer must receive a negative drug test result before permitting a CDL driver to operate a CMV (§382.301).
- Post-accident – Drug and alcohol tests may be required after crashes according to the following chart (§382.303):
- Reasonable suspicion – Drivers who appear to be under the influence of drugs or alcohol can be immediately tested (§382.307). You need to train CDL driver supervisors to detect the symptoms of driver impairment (§382.603).
- Return-to-duty – Required for drivers who tested positive, refused, or otherwise violated the prohibitions of 49 CFR Part 382 Subpart B; and who have completed the return-to-duty process with a DOT-qualified substance abuse professional. This test is directly observed, and a negative result is required before resuming driving duties (§382.309 and §40.305).
- Follow-up – Required for drivers who tested positive, refused, or otherwise violated the prohibitions of 49 CFR Part 382 Subpart B; and who have completed the return-to-duty process with a DOT-qualified substance abuse professional, and have tested negative for a return-to-duty test. This testing is prescribed by the substance abuse professional for a minimum of 6 directly observed tests in 12 months, but can be extended an additional four years (§382.311 and §40.307).

Not on the regular but they do have a consortium for random drug and alcohol test.

Lmfao i had to look them up. Drove teams for em and we used to joke that they were run out of someone's basement or garage. Never met em but I still heard all the drama between the owner and her ex husband who was a dispatcher. Had a drunk partner that would stay on the phone flirtin with her at night. After I left they tried to come after me with load abandonment. That company is sure enough a joke.

For the record I currently have 2 trucks leased in with them and they are a great company to be leased onto. They give you 98% of gross, minus your weekly fee and fuel. They pay your auto liability and cargo. You have to get physical damage and bobtail. I have my own reefer so my escrow is only like 2500$. Recently i had a trailer breakdown that cost me 4000$ and em way issued me an efs check to cover the repairs and used my escrow to cover part of it and took rest out of my check. I was so grateful for them helping me out...yeah now im paying 250 out of ea settlement again until my escrow is back up to 2500$ but that was better than coming up with the 4k myself. Since then i bought a brand new reefer and a new truck. I have made more $$ with em way than any other company. They charge a flat fee each week not a percentage. Trailer rental is cheapest and its a brand new dry van. Yes if you go out and get a bunch of bad inspections and violations yes you get fined. But it ruins it for the rest of us when idiots run out and get bad inspections and tickets etc. ..so i agree with the fines. Love this company...highly recommend em way inc. ..been there a year now.Nolelover61 and mwhjr1988 Thank this.
