OH GOD HERE WE GO AGAIN. CAN WE PLEASE POST IN LARGE READ LETTERS TO EVERYONE ON THIS SITE, THAT THERE IS NO LAW PROHIBITING CARRY OF A FIREARM IN A COMMERCIAL VEHICLE. WHERE DO THEY GET THIS STUFF. EVIDENTLY ALOT OF TRUCKING SCHOOLS ARE PUKING THIS STUFF OUT TO STUDENTS. MY OFFER STILL STANDS. IF YOU CAN SHOW ME THE STATUTE IN THE FHWA, I WILL SEEN YOU A MONEY ORDER FOR $100. SHEESH!!!

I think that schools and companies are telling their students that line of BS so they won't carry and possibly be a "liability".
I think most companies prevent carrying in their handbooks or whatever anyway, so you are taking the risk that you may be fired if discovered carrying... -
I've known of truckin' companies who include a NO FIREARMS in their handbook rules. But truth be knowed, they really don't care. All the rule is for is to avoid being included in a lawsuit that may arise if one of their drivers used a firearm, and were charged with a crime for doing so, especially if they used it, --- rightly or wrongly.
They just point out that the driver violated the company rules, thereby relieving the company of blame.
Basically, the companies are just sayin'
If you carry, and are caught, and it's construed to to be illegal --- the driver is on their own.

As someone who is currently in school, I can say that our instructor said yesterday that there is a federal prohibiting firearms on all commercial vehicles. Being well versed in gun laws (mostly in my state) I didn't buy it and set off to do my own research. After reading this whole thread I'm glad I didn't just take his word for it.otr500 and photolurp2 Thank this.

I hold A Michigan CCW and have since I was 21....Now Michigan has what is known as Reciprocity with other state that have the small training requirements so that means that I can carry in:WA,ID,MT,WY,ND,SD,MN,NV,UT,AZ,NM,TX,OK,CO,KS,MO,LA,MS,AL,GA,TN,KY,FL,SC,NC,VA,WVA,OH,IN,PA,VT,NH,DE,AK.
Now the States that do not allow or do not have reciprocity with Michigan I have to fallow the laws of that state for transporting a firearm, Norm is unloaded in a case and not in the drivers compartment (with in ready access to the driver so under the bunk works) and ammo stored somewhere different.
Newbiewannadoitright is dead right nowhere in any D.O.T regs dose it say it is Illegal to care a firearm in a C.M.V...This was a show topic on the Lock ridge report on Sirius road dog and Texas Trooper Monty Dial was the one that gave the final answer on carrying in a truck.
Now everyone knows if you are going in to Canada DON NOT HAVE A FIREARM IN, ON, OR NEAR YOUR TRUCK...New Canada law on crossing or bringing a firearm into Canada with out the proper paperwork will get you jail time and fines...NO EXCEPTIONS....
Companies that do not allow firearms on the property: OK hard one but I will try...KEEP YOUR MOUTH CLOSED....It is a CONCEALED carry...If you go to a receiver that dose not allow weapons on the property then A.S.A.P unload and store your firearm and keep your mouth closed....If a company said no cell phones on the property would you run and tell them you have one or what......
Company Driver's your stuck fallow the rules.....it's your risk....
As you run down the road look around at the cars passing you and ask yourself "Who is a CCW holder?" if you can't answer that would you try to rob one of them at a rest area?

You go to ports so you have your TWIC card?
The time line varies but in 2009 access to ports will require this. If any drivers read this and do not know what a TWIC card is then you might want to check on it. It will be required for all ports, military posts, and any place under Homeland Security jurisdiction.
All ports will be under the "new rules" and a driver trying to enter a controlled port(which will be--as far as I know--all ports) will probably face federal gun charges. This will actually end up being at least two charges with a gun charge enhancement. In other words a commission of a crime with a firearm.
If it has not been posted yet I would like to add there are other areas that I think will be added. There has been a push to register drivers hauling food grade freight. It is easier to keep a driver responsible than to put a tamper proof lock on the doors thus taking the driver out of the equation.
I imagine that in the future all drivers will be required to have a TWIC card. It cost $130.00 and is almost the same process(and price) as adding a hazmat endorsement. Since it would have meant taking revenue from states it will remain seperate, as money is far more important than safety--right?.

After many, many posts I am glad you agree. There are NOT any rules(DOT) against carrying a firearm in a commercial vehicle(yet) nor are there any Federal laws prohibiting such as it would have been included ASAP.
Please note: a driver discussed leaving a gun at a gate. All drivers should understand that attempting to bring a gun to the wrong place could result in serious jail time.
If you "attempt" to carry a gun on property under the jurisdiction of Homeland Security it will garner, if caught, the same results as "attempting" to carry a gun to an airport.
If you work for a company(not your own), or are least to a company running under their authority, you can face fines and jail time for carring a gun in "their" truck. This, of course, depends on where you are at.
I will explain for the hard to learn. This I NOT heresay. An example: La. and tx. are right to carry states. Louisiana , being for more liberal in the "right to carry" than any state, as far as I know. I am not talking about just the right to carry(concealed) with a permit.
Both La. and Tx. have laws that allow the owner of property to post, by law, that a person can not have a gun on their property.
It is not hard to understand that if you lease your truck to a company, it is considered their property. This will probably generate a lot of posts but will not change the facts. If you drive for a company based out of Tx. or La.(I know about these) and they post this(no firarms, weapons, etc.. on their property, and in their drivers manuals, rules that prohibit weapons(guns), you will be in violation of their "rules" and state laws. --FYI
