Now I am curious how this would apply to the rest of the country

Question: In Minnesota the blood alcohol limit is .08 but I have been told that since I have a commercial driver’s license, for me it is .04. Is this true?

Answer: The simple answer to your question is, "No." In part, statute 169A.20 states that it is illegal to drive, operate or be in physical control of any motor vehicle when a person's alcohol concentration is 0.08 or more. There is a clause in that statute that states that if the vehicle involved is a commercial motor vehicle then it is illegal if a person's alcohol concentration is 0.04 or more. It is not the type of driver's license, but rather the type of vehicle being driven that determines which alcohol concentration level applies.

good question.....i have even heard on the c.b. Radio that a driver is not even suppose to have alcohol in his or her commercial truck...

Is this true? Not sure, but i have only heard "stories" of people being arrested for just having alcohol in there trucks...

It dont affect me because i am clean and sober 17 years.but i have always wondered about this...

If your in a commercial vehicle

.02 gets you put out of service for 24 hours.

.04 gets a commercial drivers CDL suspended for one year for a first offense, three years if transporting hazardous materials and revoked for a minimum of ten years for a second or third offense.

If your in a non commercial vehicle, it's .08

Most companies won't let you carry it in you truck. If you get caught it's out the door and it gose on your DAC as fired for breaking company rules.

Wonder why .04 in commercial vehicle is considered "bad" but .08 is ok in any other vehicle?....isnt impared/drunk/under the influence BAD no matter what type of vehicle you happen to be driving?

I was told if you have any alcohol in your truck there had better be a B.O.L. with it. Better yet, who drinks n drives a 80,000 lb vehicle??

Having alcohol in your truck doesn't necessarily mean "drinking and driving". I brought Mescal Tequila from Mexico several times to my dad.
