    It’s an interesting business arrangement he has with employer. Must admit I don’t know anyone that does it this exact way. There are trucking companies that rent from a third party like Ryder and lease it on.

    It sounds like he’s an employee disguised as a 1099 contractor but in this case the employer has taken the extra precaution of renting him equipment and making him pay for fuel. At the end of the day though, he has no operating authority and his rent payments are building equity in equipment owned by someone else

    u are exactly right, company im with rent from a third party from penske to be exact. how im i company driver when i pay for my own toll and fuel, ifta, truck rental, trailer rental, cargo insurance explain tht. since u kno it all truck guru, im no company driver. company drivers dnt make even close to $3k. company drivers daily average $900-$1,500

    You’re an employee that’s reimbursed for expenses.

    I don’t know where to begin maybe call the IRS and ask them if you’re a owner. Make sure to tell them you don’t have operating authority and you apparently don’t pay your own liabity insurance. Do you at least have a business lisence?

    Oh...and I see you’re back to paying tolls and IFTA again. It’s Hard to keep up with a the plot changes in this story lol.

    Let me quess, your employer is leasing from Penske and deducting the payments from your paycheck and in exchange for that he pays you more per mile and pays you on a 1099. Deductions from your paycheck are the same regardless of your revenue. IFTA, nyhut, mc, dot, liability Ins, lease agreement, IRP are all in your employers name. You've been in this arrangement less than a year.

    Haven't read through all 5 pages, but that's a lesson I learned the hard way in MD the 1st week on my own. ESPECIALLY out east, check with page A16 in the Motor Carrier Atlas (state/provincial weight and size limits). PA is a 96" state, so if you had a 102" trailer you were over-width. I got stopped at the scale on US1...I had figured (wrongly) that they wouldn't put a scale house up unless it was a truck route. It WAS a legal truck route...but only for trailers up to 48' long and 96" wide. My 53'x102" was restricted...and a costly learning experience.

    You need a lawyer. You get the lawyer in the courtroom to ask officer a bunch of yes/no questions. Some of the questions he will answer "yes" to, will be totally ridiculous and will damage his credibility. A good enough lawyer will ask all these questions in such a manner, that this cop will look like a liar who remembers nothing about what actually happened, and you get it dismissed. You won't even have to show up for this
