If this had been a one horse trucking company involved, the lawyer wouldn't have even take the case. No big 60% payday for them.
Werner has said they will appeal. A couple of million will be offered as a settlement and if the plaintiff doesn't accept, the case will be tied up in court for a couple of decades. The attorneys of record will tire of the appeals and costs associated and tell the client to accept the offer on the table and take their 60%. I get what you’re saying and I agree with you. This is similar the the McDonalds hot coffee case. McDonalds appealed the original payout and won a huge discount. The woman got a fraction of what she was awarded in the original trial. But what most people don’t know is the woman didn’t want to go to court. She asked McDonalds to pay her medical and a small settlement. McDonalds told her to pound salt and I wonder if the same thing happened here. Leaves a bad taste in the jurors mouth I’m sure.

Of course it’s not the same case we were presented in the article. Did you read it? The whole crux of the plaintiffs case was that “Werner did not park as was required by every CDL holder in every state”
