    They mention the Texas Transguide message boards talking about their warning drivers of inclement weather. On I-20 leaving Dallas and heading west, there is one near Ranger I think and one near Monahans. The crash happened near Odessa. So hard to make the case the driver ignored warning messages issued by the state.

    Didn't expect them to actually LOOK the part.

    So how long until Eric Penn is arrested for crashing his Tesla while doing a line of coke off a hooker's ###?

    Steakley looks like the kind of slip & fall Better Call Saul attorney who spent years in a walk up over a tattoo parlor and now that he finally got his big score he can have his 5 o'clock shadow "professionally groomed".

    How the hell did this case even pass the smell test? I am no lover of Werner, but this is ridiculous.

    This is a sympathy ruling by retarded jurors. It’ll be overturned on appeal.

    Werner should sue them for damaging their truck.

    It’s common for a jury to feel bad for someone and just make the other guy pay. If the money came out of the jurors pockets they would have ruled differently.

    Remember u.s. senator john edwards who ran for vice president?

    He made millions suing doctors, falsely arguing doctors responsible if child born with down syndrome.

    The scientific evidence was on the side of the doctors, but emotional jurors would rule in favor of the wrong person.

    We suffer the same problem on the us supreme court with liberal justices who rule based on what they want rather than whats right.

    The only reason they got that "award" was because They hit a truck....had they hit another car, damages "awarded" for THEIR stupidity wouldn't have been near as much!

    That goes without saying but more specifically, they hit a vehicle owned by a corporation with massive cash and liability umbrella policies. It could have been one of Taylor Swifts tour buses and would probably have also generated a huge effort to seek a huge cash payout in a simple settlement. (Nobody in the public eye wants bad press)

    If I had to guess, an offer to settle for probably less than $2 million was rejected by Werner. They took their chances and lost big. (Both sides took large risks, but one side lost in a big way and on the other side, the opposite occurred)

    Hopefully the appeal will set legal precedent on how to go forward in the future. Also, I have testified a couple times in federal court and witnessed the abject stupidity of jurors. One found a drunk driver not guilty based on one of those roadside speed indicators that tell you your speed. How did 12 of our peers rationalize that? They said that if it were more easily visible to him, he would not have sped and I would have not known that he was drunk. I don't know how that added up in the jury room, but whatever. Dude dodged his THIRD DUI in one year. It happened on a military base so it automatically went to a federal magistrate court for prosecution. Judge didn't even flinch, so I took that to mean that he sees dumb decisions like that daily.

    Replying to an older thread I know, but...

    I was going through some old thread because I can't sleep and started reading this one again... I logged into the courts website to see any progress on the case and this was the last order by the judge....
    Order by the judge dated 6/29/18

    "ORDER
    On this day came to be considered Plaintiffs’ Motion for Judgment and Defendants’ Motion to Disregard Jury Findings and for Judgment Notwithstanding the Verdict (JNOV) and Response in Opposition to Plaintiffs’ Motion for Judgment. The Court, having considered the motions, the record, and the arguments of counsel, has determined that Plaintiffs’ Motion for Judgment should be, in all respects, DENIED, and Defendants’ Motion to Disregard Jury Findings and for JNOV and Response in Opposition to Plaintiffs’ Motion for Judgment should be, in all respects, GRANTED.

    It is, therefore, ADJUDGED, DECREED, and ORDERED, that judgment is hereby rendered in favor of Defendants Werner Enterprises, Inc. and Shiraz A. Ali that Plaintiffs take nothing on their claims against Defendants. This judgment fully and finally disposes of all pending claims and parties. All court costs incurred by Defendants Werner Enterprises, Inc. and Shiraz A. Ali are taxed against Plaintiffs."

    Looks like the judge followed the law after all, and struck the jury verdict 100% Not only that, but ordered the plaintiff to pay all Werners (and Ali, the driver's) legal bills.

    Now the plaintiffs can appeal I'm sure, but at this point it's a huge uphill battle as it will be handled by judges who rule based on law and not emotion.

    Kinda glad no horrible precedent was actually set.

    P.S. They finally got the original Final Judgement posted where Werner lost. The driver, Shiraz Ali also had a 2.5 Million dollar judgement against him personally. Of course that was vacated by the Order I quoted above.
