We hauled a car from Manheim Hobby Houston, TX to Chantilly Auto Sales. truck broke down and was a few days late for delivery, customer was advised of delay. Customer requested we deliver over weekend, though office was closed. Told our driver he would mail payment to our office. In good faith, and because we were late, we agreed to deliver car. Car delivered 5/ 29/ 2018. No payment sent. Called Atiq Hafiz for Payment Monday, and he said he would not pay us. Spoke with him again on Wednesday and he stated that since we were late for delivery he would not pay us for this transport. No where on his dispatch did it have a penalty for late delivery. Truckers beware!

Are you based out of TX? If so, you can, and should file suit against him and his business in small claims for the delivery charge, court costs, pain and suffering ( min. Equal to the delivery charge). It’s not that expensive to do and you don’t need an attorney. And he will be of more a mind to pay u cause he probably won’t want to come to Tx to have his butt handed to him for the suits value.
If he doesn’t pay and doesn’t reapond you will be able to get a summary judgment against his business and him. -
You have to bring action against non payment in his local court system.

You left a blank check with dropping it with no signature. I don't think you will have too much luck in getting paid.

Not true, signature will help but no signature does not mean the car wasn't delivered. Does the customer have the car? The answer is yes that means he took delivery. Simply file a complaint with the local law enforcement will make the thief very uncomfortable, even if the cops don't do anything the complaint will be on file starting a record on him. After many complaints filled on the thief (because he most likely has been doing stunts like this to many people) he will become 'well known' to the local cops and they will take actions. If everyone who's ever been stiffed by this guy decides to 'let it go' because 'it's not worth it' then he will keep on doing it.

Contact the bond company. You will get paid, I was recently in a situation where a company told me for 30 days "the check is in the mail". The bond company gave the broker 24 hrs to respond, then issued payment. This resulted in them canceling the bond coverage for the brokerage that failed to pay. During the additional few days it took to receive payment we were told they had also failed to pay several other transporters. Without the bond they cannot continue to broker shipments.

Actually no. The suit is filed in the jurisdiction where the harm took place. Same with anything. If Im from TX and rob a store in KS they dont put me on trial in TX. Same thing here. He failed to make payment to the carrier located in TX. The harm occurred in TX, not where the broker or whoever is domiciled. Same if you get a moving violation in CO and you’re ased out of NV. You must contest the violation in CO, not NV.
