Hey guys I'm a new driver and work for SWIFT. I was assigned 8 Risk Analysis points for a hard braking event because a car changed lanes in front of me without signaling and immediately slammed on his brakes. He brake checked me on the highway and I almost struck him. Thankfully I was able to brake and avoided the collision. I had no time to create any following distance as he brake checked me right after pulling in front of me. Anyways I got hit with 8 points for "near collision" and "failure to keep an out". I feel this is unfair as I did the best I could to avoid the collision and I don't think it would have been a good idea to swerve out of the way and possibly hit another car or lose control. Does anyone know if I can contest these points?

Yeah it's really disheartening that they are punishing me for avoiding a collision from a brake check. I could understand if I was following too close but the guy swerved into my lane right in front of me and slammed on his brakes. I would think they would congratulate me on avoiding the collision but I got punished for it.laaylor, Dave_in_AZ and jsnell Thank this.

I would've been inclined to tell the a-hole in safety "If you don't want me using the brakes, next time I'll just hit the mother(NSFW)!" If you've got a dash cam, show them what happened.
Crap like this is one reason I won't run any carrier's ELD/fleet management system in my truck. The company doesn't need to collect any info beyond that which is required by the regs.TripleSix and Dave_in_AZ Thank this. -
I don't know. He flashed his high beams at me before he passed me and got in front of me and slammed on his brakes. He either wanted me to hit him or to slam on my brakes.

Was he trying to get around You? Did he pass you on the right then brake check you?

The drive cam did record this event which is why I'm baffled that after reviewing it (which I hope they did) they still faulted me for avoiding the collision.
1. Near collision - I can understand getting hit with this however not when I wasn't at fault.
2. Failure to keep an out - I dont know what they expected me to do other than remain in my lane and hit my brakes. Would it have been better to swerve out of the way? I would think not as this could cause me to hit another vehicle or jacknife.
I just dont understand why I am getting faulted for avoiding this collision. I would think they would go after the driver that brake checked me by giving the footage to the authorities -
Yes he passed me on the right side then brake checked me immediately after getting in front of me. I was on the second lane from the right in a 4 lane highway. This was after 2 highways merged so I didn't have to opportunity to be on the furthest right lane

Like I said, I'd be inclined to say "OK, next time I'll just hit the MF."
