I would have had to slam on my brakes either way. I avoided the collision. I had no opportunity to create followind distance as he brake checked as soon as his car was in my lane. It wasnt like he took his time getting into my lane either. He didnt signal and just jumped in front of me. It makes no sense to get faulted for braking to avoid him. There was no opportunity to create following distance without a hard braking event as he braked as soon as he was in my lane.

I honestly didn't know Swift points were a thing until recently so please forgive my ignorance in this next question. How do other companies look at those points when considering a former Swift driver for employment?

I dont think it would have made a measurable difference as he when he braked he was going the speed limit and so was I but by the time he took off we were at a rolling stop. This wasn't of those those brake checks where they do it just enough to scare you but he did it with the intention of me actuallt hitting him. Once he saw that I wasnt going to hit him he took off. Perhaps the only other thing I could have done to avoid this close call near collision would have been to not only brake as he was coming in but hard brake enough to trigger a hard breaking event. However it would have been unreasonable to brake this hard just because he cut me off as there were no vehicles or obstructions ahead of him that could give me an indicator that he was going to slam on his breaks. Can you imagine triggering a brake event every time a car changed into your lane too closely?
