And yes I have reviewed the video many times over and even showed fellow truck drivers and they all agree that I did all I could to avoid the accident. They are also baffled as to why I got punished with points for doing what I was supposed to do given the scenario

Those “points” are fairytale points. Ignore them. Maybe instead learn something or another such as anticipating when others might change lanes. That’s right. Learn ESP. Develop a sense of what others could potentially do at any time. Then increase distance. But don’t lose sleep about Swift points.

You didn't get points for the hard brake. You got them for not starting to create distance as soon as he started coming in.

How long have you been with Swift and are you in some kind of contract with them?

Following distance or late response weren't points assigned to me. But from now on I am going to start braking firmly every time someone gets into my lane and is relatively close to not give them a reason to hit me with "did not begin to create following distance immediately". The thing is that 99% of the time when a 4 wheeler gets in front of you its simply to pass you. Oh well I guess its best to act like Im going to be brake checked everytime in order to avoid risk analysis points

No contract and just a few months. I like swift they have been very good to me which is why I don't understand their safety department punishing me for avoiding an accident given the scenario. Im going to give them the benefit of the doubt and assume it was an algorithm or someone that didn't review the video closely. I'm going to contest the points.

Well you are correct for the wrong reasons.
Any company can say anything they want about you as long as it's true The date and rehire are simply a best practices to keep the civil suites down. Can't sue for slander with hard facts.
The reason though that it doesn't matter to the op is no one cares. Those points are 100% Swift internal system. No one wants to learn Swift's system to see if you are a bad employee, or if Swift is just being a large company bureaucracy.
That being said, I'd still fight safety on it in your spare time as it will affect which level of bonuses you get, hence how much money you bring home.ThreePedals Thanks this. -
I was going say if it were me I'd start triggering braking events everywhere I went just to get those points up and see what their threshold is. But that's because I can be an absolutely ignorant prikk when I put in the effort. If you like them then please keep your eyes peeled and stay safe. In my limited experience I always expect the worse from people in cars and am genuinely surprised and grateful when they commit an act of decency. Guy flashes his highbeams, then passes you on the right. My immediate thought is he is going to do something stupid. "Failure to keep an out" refers to many things, in this case following distance. My "out" when I see a jackwad cutting me off is get on the brakes asap. That is what Safety Guy is seeing and trying to communicate (I assume).
When you review these things with safety:
- State what you did right
- State what the other guy did wrong
- State what you could/will do differently next time to avoid the situation in the first place .
