Quick call to an attorney specializing in this confirms that in TEXAS, you can not expunge misdemeanor assaults against a family member. Which means that it doesn't matter how old it is, or how minor, it cannot be expunged.

great time to ask this question? I was arrested twice, both misdemeanors, but was given an ACOD on both. For those that don't know what ACOD means, it means if you DON'T get into any trouble after a year of the arrests, it gets dismissed. Both arrests happened more than 3 years ago. If I haven't been in any trouble since my last arrest, (June 2006) and I received an ACOD, would it come up on a background check? An honest and a accurate answer would be great. I haven't gone to a attorney to find this out because that would cost money, and I don't have much at the moment.

The arrest record, charges, and disposition will be a matter of record until expunged. Pending charges along with the next court date are also present.

Dispostions!! thats what I received in both my arrests, which was the ACOD's. I also forgot to mention that I have my Hazmat. If DHS did a background check on me and still gave me my Hazmat, then would my arrest record be dismissed already? I forgot to mention that earlier. I have no pending charges or tickets or anything. I figured since June 2006 was the last time I got arrested and given the ACOD, it would have been dismissed by now? What does anyone think of this? Please give me some advice.

The best advice i can give you is to go to your local law enforcement office and have have your criminal background check done. Here in GA it costs about 20 bucks, then you know what's on your record and can then start getting it straight.

Only certain felonies keep you from Hazmat, most of them dealing with crimes IN a commercial motor vehicle. Getting it doesn't really mean anything about what they saw.

hey cajun, thanks for the private. Its very much appreciated. Im glad that everything worked out for you. Couldn't write back in private cause I dont have more than 50 posts, lol. I wll have to go to my headquarters to get my report and see if its good. Im sure it should be since I wasnt convicted of my misdemeanors, I received the dispostions on both, but to be sure, I have to get it. Thanks again
