    Is this FedEx Ground shuttling doubles ? If you are assigned to that same route every day you are an employee . If he shuffled several drivers around on several routes and you had a choice of what route to run on different days he might get away with the contractor thing . This was how Fedex resolved the issue when courts decided FedEx Ground parcel van O/O's were employees . FedEx eliminated all single route contracts . If someone contracts multiple routes they are a contractor .
    You might consider joining OOIDA . If other drivers want to file suit OOIDA may help them .

    I miss read hes a company driver I thought he was a O/O than its legal.

    Have you contacted the IRS and reviewed the Pub 1779?

    I have dealt with OOIDA. You sometimes get the wrong advice. They are not responsible if the wrong information is provided.

  7. so i am an employee driving his truck running local routes which pretty much change daily or? furthermore who do i inform as to what he is doing

    First step is the IRS. Call them and tell them how you are being paid.

    Refer to the Fedex problem.

    Many of the states are also looking into this. It is wrong, and many do it.

    I wouldn't take this job. You become unemployed and he is not supplying you with any insurance (workmans comp or regular health benefits), isn't paying income tax you will have issues to deal with. you may wind up paying more than your fair share of the income tax. If this is the case you should be making 20%-30% more than what you feel is a fair wage to offset your costs to insure yourself and pay estimated quarterly taxes. That $550 becomes like $400 or less a week after you pay your quarterly taxes. If you don't pay your estimated quarterly taxes because it hasn't been planned for than you'll be in a world of hurt.

    Thanks for the advise I have read on this page. I have been working for two seperate Bosnian companies out of grand rapids michigan. they listed me as an independant contractor/1099. I drove their trucks all 48 states, many times putting in 20 hour days. I used their fuel card and was dispatched by them. They said no forced dispatch. BS, if you refused you were fired. Everything I did was the same as a company driver. If anyone knows of a good lawyer on contegesy as the companies also screw you out of the last two weeks of pay. Info would be appreciated.
