log says sleeper, but...

    im sitting in my driver seat smokin, reading, plain old sitting, am i in violation?
    another driver and myself were debating weather or not we are in violation if our log says sleeper but we are sitting in the driver seat? whats the deal

    There are 3 ways to log while in the truck , driving , on duty , and sleeper berth . Sleeper berth means exactly that . If you are out of the sleeper you are considered on duty .

    Are you in the sleeper? No, so you are in violation, period. By the way were you out of service today at a scale? I had two driver's who thought they would take there 8 hrs. sleeper in the front seat, walking around B.S's on the lot and such.

    yep. you are! i prefer to put my laptop or book up on the steering wheel when parked. i just DO NOT like the confines of the sleeper unless i am sleeping.
    i prefer the natural lighting and having windows around me LOL

    It blows, but yeah every one is right, If you are in the driver seat your on duty.

    This is where legal expediency takes precedent over the intent and spirit of the law.

    There are so many areas in life like this that the word criminal has lost a lot of it's bite in modern language.

    My front cutains are closed so you don't know what I'm doing ... and I just might be doing it in the driver's seat. :biggrin_255:

    This is just another example of the idiots that make and enforce the rules not having a clue. Do they really think that just because a driver is in the sleeper berth he's resting, or that it's not possible to incorporate the driver's seat during their rest period? It's even more idiotic when you consider a team arrangement and the fact that if the resting partner sits in the passenger seat they too are in violation. They obviously have never tried to stay in the sleeper for 10 straight hours day-after-day ... especially while driving through California.

    Ofcourse, while in the sleeper, while team driving, we all wear our safety bunk belt as well huh, lol
