Except that she had disclosed the issue before she started working for them and they had accepted it until they started changing her schedule up,which hence led up to legal action.

...... by not knucking under! You can stand up for your beliefs, and have some dignity at the same time. Everyone is such a victim these days. Going for a big payday and capitalizing because you got wrongfully pushed out of a crappy entry level job, is not the way to do it. That's just my opinion though. It may come off as insensitive, but oh well.
This is not a hard job to replace. If someone is happy to wash dishes, there's a million other entry level jobs like that to choose from. I would have cut a finger off for 100K when I was a dishwasher! Sure there might be a little jealousy in my comments, it just don't sit right with me. Recoup your costs, go find a new job and get back to work.
I do believe she is entitled to some cash money, but like I said before, not this much! I get how an example is trying to be made of the company, but even at that, millions upon millions for one or two managers being dicks.... nah, way too much. I don't know what the answer is, and big money seems to be the only way to get through to these companies. That is the crappy thing here. Everyone needs to calm the hell down with suing the pants off of each other. Its gross.
"How can I take advantage of this situation and get paidddddddd?"
The Werner suit, these pathetic shlubs that sue someone cus their "marriage fell apart" when they just simply lost their woman, idiots burning themselves with coffee, 2mph fender bender life altering permenant neck and back injury, it's all the same. In my opinion. That turned into a bit of a rant, so sorry to take away from the actual story here ha! -
after reading the article again, i am of the wondering if the person that hired her, (maybe the hotel manager??), only said it was ok for her to have sundays off, as it was between them at the time, and that person fully understood, then that person got transferred, never informing corporate, or the future manager...??
but frankly, that is an award that she will never get, since it is capped at $300,000, minus the third the lawyer will get, leaving her with about.....$225,000, still not chump change, and i'm not sure if that is also subject to taxes.
i know insurance awards are not taxed, can't say about lawsuit awards however. -
I would totally agree
I would totally agree with you on this one, but there was one factor in this that the corporate conglomerate screwed up. They set a precedent by giving her Sunday off in the past because of her religious convictions, then pulled the rug out from under her. No win scenario. She wins.............. -
Well if employers FOLLOW THE RULES AS THEY ARE WRITTEN then they don’t have to worry about being penalized. It’s that simple. And it was a jury who decided the amount, not the judge or the lawyer. You break any of those rules- you are literally going to pay the price-and the jury made that known.
And incidentally regarding the Werner suit-the judge threw the judgment out and found in favor of Werner so plaintiff has to pay all legal fees and court costs!Last edited: Jan 18, 2019

I hope the plaintiff now sues their ambulance chasing attorney for malpractice.

Not true; that is based on a misreading of documents. The case is currently on appeal by Werner.

Actually it was discussed that the jury verdict was thrown out.
Werner hit with $90 million dollar verdict -
Yes, it was discussed, but it is not correct. The false assumption that the verdict was vacated is based on an unsigned document in the court's case file. The final (signed) judgement (image 81012592 on 07/30/2018 if you're interested) upholds the judgement. Werner is appealing the decision. I posted the same information in another thread:

Well we’ll just have to wait and see what the final outcome will be.
