Then the question would be an endorsement on what? Unless you are suggesting that the final rule clarifying the definition of tank also changed the definition of CMV for CDL purposes in 383.5, there is no CDL available for 26000 or less under 383.5 on which an endorsement can be assigned unless hazmat is required.brian991219, Accidental Trucker and BoxCarKidd Thank this.

Not to revive a dead thread, but this thread illustrates a very troublesome point. We have two respected members of this forum, both commercial vehicle enforcement officers, with differing opinions on if a tank endorsement is required for a vehicle under 26,000 pounds gross vehicle weight rating.
Unfortunately one of them is wrong, and it could cost drivers a small fortune to challenge their incorrect assertion. Sorry @Scalemaster this time you are incorrect. @keitht has it correct.
The issue of requiring a tank endorsement on non-cdl vehicles should be looked at the same as the air brake restriction, unless the vehicle is in group A or B, or is hauling haz-mat or 16+ passengers it is not subject to any of the cdl provisions. As a former cdl examiner I can guarantee this is the correct approach.
Keith explained it best with his breakdown of the logic behind why a tank endorsement would not be required. I only wish I had seen this thread back in 2018, when it was fresh, so I could have made sure the OP received the correct guidance.BoxCarKidd Thanks this.
