Lets break this down, It's been 2yrs and you haven't done anything about this. Not that I'm saying your guilty or anything but it dose make one wonder.
Swift has had 10's of thousands of drivers come and go sense then. They don't remember you nor do they have the quallcomm msg. Which meens your SOL proving anything there.
Swift has 3 lawyers on staff. After 2yrs any good lawyer will tear a story apart. All they have to do is get YOUR witnesses on the stand and ask them EXACTLY what did they hear. When the stories don't match. NEXT CASE!
And the media. You have no hard proof. Just your word about something that MIGHT have happend 2yrs ago. Why should they care or belive you? 100's of drivers get busted for positive test and refusels. What makes you different? Because after 2yrs you SAY you are innecent.
Like I said before. not saying you did anything. But after 2yrs, one has to wonder.
GETTING CDL CLEAN after SWIFT

Point is i spent almost 6 months after the fact, trying to get this cleared up. It came down to the DM not wanting to be honest that it was mis-communication on both our parts but as I said my family was right by the phone as it was my daughters BD and we were at dinner. So for him to lie about what he said to save his own ### is wrong, I've spoke to just about everyone in Washington even former sect of trans Mary Peters, she took there side. well anyways

Notify Swift of a pending Lawsuit due to the blatant discussion of medical information in front of non need to know personnel in violation of the Health Insurance Portability and Acountability Act (HIPPA) and see how fast they help you out.

Chipperi, I will do that, I am also in contact with DACFIX, I have to get 170 up and i've already got my DAC from USIS. and they say there percentage rate of fixing drivers DACs is 70% so I hope I dont fall into the other 40%,,,just my luck thanks

This is one thing that gets me riled up. We get a ding and it goes on our permanent record. It's next to impossible to get a whole gaggle of non-communicating people to correct a rather obvious and very blatant mistake and instead of someone taking a reprimand which in no way jeopardizes their career like it does ours they sit there and do nothing. I got a few that will be getting my own comments added when they go up on my DAC and they are all verifiable with evidence that is readily available.
It's a real shame that a few bad apples in a bunch are willing to yellow tail it out and make some of us look so very bad when most of the time we are doing above and beyond expectation. There really needs to be another way to do things besides having to hold evidence and post comments in our own defense on the DAC.

Always three sides to every story, yours, mine and the cold hard truth. His doesn't hold water.
-
have you tried speaking with the new secretary of tranportation? i would try every legal avenue that i could take.

Whos does not hold water, Mine or his( the Driver managers?), I Just email my local Senator what happened as due to someone saying contact Ray LaHood, the #### guy dont even have an Email link . Some government we have but #### then know how to contact you to be ReElected, go figure

Like I said in one of your other crybaby posts asking for information on the same thing to wit: 382.305(l); driver must IMMEDIATELY report to the collection facility. Did you report immediately.........no you didn't. There is no rule in the rules that allows you to make "deals" with the dispatcher to go after dinner or whatever it was in the other post.
In addition, you acknowledged that you were to provide the specimen twice, once by answering the Qualcom, then again after you called your dispatcher to make your supposed deal. God Almighty can't fix your screw-up's and failures especially considering your ignorance of the law which again is no excuse.
Instead of you attempting to receive sympathy from these people, as well as Ray LaHood, why don't you accept the fact that you screwed up and move on.
