It's basically letting someone without a CDL drive your truck. They don't have a valid CDL, they can't legally drive. You aren't required to be all knowing and all seeing, but you are required to take some reasonable precautions. Hiring them without a pre-employment drug test would be a bad idea. Letting them drive after notifying you they failed a drug test would be a bad idea as well. You would be fined for failing to do what you're legally required to do. If you heard from the grapevine he failed a test but he didn't notify you then you might dodge that bullet as far as a civil fine. A wrongful death lawsuit might be a whole different story if they can prove you had reason to suspect. Other than that though you have specific legal duties to perform and failing on any of them can result in a fine.
