This is a strange argument some of you guys are having. Doesn't matter "what if" anything. We know what happened in this particular case, so that's all you can go on.
Bonehead decided to take his ten on the shoulder of a interstate and was involved in a accident with fatalities.
I don't know what the punishment should be. Pretty sure the driver is dealing with his own punishment mentally. I'm also sure he should never be allowed to ever operate a CMV again. -
Why, the SUV driver hit a non moving object that was out of the travel lane. Hitchhiking is illegal on most interstates as least from what I've seen, if you hit a hitchhiker nobody is going to blame the hitchhiker. Should the truck driver have been there, no and nobody is disagreeing with that, is it his fault somebody else drove drunk or fell asleep at the wheel and hit him, not even a little bit.

None of that matters. He was parked illegaly for no reason.
This is how it works. The trucking company's insurance will bear the storm of the lawsuit. Company then buys new numbers, complete with cardboard lettering. Driver works the drive threw of taco Bell because he already has blue tooth head set experience.

And that is the problem, nobody cares how many laws were broken or what new level of stupid the car was on, is all that matters is they hit a truck and now somehow they deserve money. If they had lost control and hit a truck in a parking area where the truck was entirely legal to be, they would still be after money from the company.allniter Thanks this.

No, there's not much shoulder to park on on two lane highways. I wouldn't park on the shoulder unless I was broke down to the point I couldn't move, I know what sort of stupid people are driving around.

No, the suv hit a parked vehicle, big no no even if they're parked across the road. Once again, change the truck to anything else illegal on the side of the road, a horse and buggy, Mormons with a handcart, would you blame them for getting hit or would you blame the other driver?
