hey guys i worked for this trucking company here in kissimmee fl for 3 days then i quit because they were really shady in doing business and i didnt want to be apart of it. they say they will pay me last week tuesday but its been over a week and each time i contact the owner he says he will pay me at the end of the day but he doesnt. it a 1099 company driver job. am i screwed or is there a legal way i can purse this? i really dont care how long it takes. thanks.

If you are a 1099 holder for that job, you will be responsible for everything. Taxes withholding etc. If you don't know what you earned, you don't know what to pay and Uncle Sam will not like that at all.
I would take this to the state's labor board or at least the unemployment board. You probably will not get unemployment for quitting but people there will see how best to pursue against employers. Maryland awarded me and a dozen child age workers wages against a employer a long time ago and he probably has passed on by now based on age. Just as well. It was more dangerous for the child workers than it was for anything else really. I kept a pretty good eye on my wages but even so, there was about a little over 300 dollars embezzeled out of my pay (A word that best fits in reverse, usually it's the bad worker stealing from company)truckdriverslave82 Thanks this. -
Your first paragraph applies, your second one does not, he was 1099.

Ok then it's small claims time. It's easier to get this going while everything is still fresh and his retained logs proved that he did work and so on along with loads delivered and so forth. If a company has not paid by now they arent going to. Im fairly sure there is something deeper into this story but at face value, Im pretty sure the employer found someone else and forgot about this one by now.

....and from now on work for a reputable company. No company is perfect, but some are better than others.
Check with DHL; a huge worldwide company. Lots of various types of driving jobs. Terminals all over the nation and maybe 3 or 4 in Florida.

There’s no such thing as a 1099 employee. You will either have to go to small claims court or chalk it up as a bad decision and move on with your life. You are offered no protections that a normal employee would have when you choose to work for company that breaks the law by paying you on a 1099.

Which is why it will be a great time to get together with the IRS via a tax preparer and make ready for the penalties and so on that might be possible against this employee. Uncle Sam wants his money. Either in full or withheld etc. If the IRS chooses they can lay waste to that employer's ability to do anything with money with liens on house, anything of value etc.truckdriverslave82 Thanks this.

actually i would like to move on as it isnt alot of $$ earned here. But i think the reason why there doing this to me is because they did it before to other drivers and gotten away with it because just maybe the previous drivers had that same thinking "ill let it go and make a better decision next time". I think i would of gotten paid already if they knew they couldnt get away with it. So i need to prove that they cant. This is not the right way to conduct business. For that reason, if it dont get paid its not alot of money lost. but if i do get paid they know they cant screw future drivers.
I just need help on how do i begin? i was hoping that there was someone on here that went through this? please dont tell me im the only one!!
