BELOW I POSTED THE CONTACT INFORMATION TO THE 7 AREAS OF MN COMMERCIAL VEHICLE ENFORCEMENT. PERSONALLY IF I HAD QUESTIONS SUCH AS THESE I WOULD CALL AND ACSERTAIN WHAT IF THIS, WHAT IF THAT? THEY ARE THE ONES DOING THE SURVEY, SO BETTER TO GET IT STRAIGHT FROM THE HORSES MOUTH.

Perhaps all truckers going through Minnesota should get a small digital recorder(ie dictation type found in office stores). Turn it on when stopped
When asked to take the driver fatigue survey, simply ask if your are required by law to take the survey. If enforcement asks(or states) that you are refusing to take the survey. Tell them NO, you are NOT refusing to take the survey... You are unsure of the law, and want to know if you are required by law, to take the survey.
If enforcment says YES, you are required, by law, to take the survey. You should have this recorded, and take the survey, getting the officers name and badge number location ect... (use for possible class action lawsuit)
If enforcement says NO you are not required by law to take the survey, but pull over for a level 3... again recorded, and coercion noted. (again, use for possible class action lawsuit).
If enforcement says, NO you are not required to take the survey. Again DO NOT say that you don't want to take the survey... Merely ask if you are free to leave... If yes, thank the officer and move away(ending the recording). If you are NOT free to leave, keep recording and keep asking the questions about the survey.
Keep in mind, certain power monger enforcement officers can get real testy with you when doing what I suggest above, simply stick to you guns and keep recording(chances are that they are recording you as well). -

Be careful of illegal wiretapping laws. In some States what you posted is illegal. In my State, for example, you could be arrested and charged with illegal wiretapping. I know your saying but the officer is recording. Believe it or not, not all stops are recorded. for example in my cruiser, I don't have a camera system. There are also laws that require some agancies to record all stops. This is done on a State by State basis. There was an earlier post about recording traffic stops and voice recording. Again I caution you as you may be involved in illegal activity. -
We have been down this road before and in most cases recording is perfectly legal as long as you're not intercepting a signal deemed a "private" conversation, many states even waive this if there is a crime in progress(coersion via blackmail... as in.. Take the driver fatigue survey or get a level 3)
Again, there is just NOT sufficient expectation of 'privacy' from a law enforcement encounter to deem recording the event meritable under wiretapping and eavesdropping laws.
Fortunately, enforcement activities by law are not deemed 'private'. One can remember the history of 'private' enforcement activities the Gestapo used(in horrorfying effect) in Nazi Germany[people taken away for no apparent reason and put into camps Jew and non-Jew alike]. Thank God, we are not there yet. -
I really believe there is no violation of taping any event that is an open meeting. If in doubt, advise the officer. You are not listening in or using a phone intercept.
A question arises as to the legality of the officers dash cam recording and violating a person's rights. It would be the same if the trucks dash cam picked it up. -
I was under the impression it was a matter of admissibility, not illegal.
MN is kind of odd. I was there last week. While I was going down one route, there was a confusing sign that said all trucks must enter weigh station on such and such other route. I really had no idea what to do, another truck went down that ramp and another truck and myself just kept on going on our route.
No one came after me but I still have no idea what I was supposed to do. My thinking was that the weigh station was so close to the on-ramp that those going that way needed the extra notice.
Anyone ever seen that?
