I know what I would do, but I best not be telling anybody else.
The man would owe me if I delivered the load, or loads, I don't care if he ever got paid. I never once didn't pay a driver because I did not get paid for a load I had them haul.

    Badmon and Ragman54 Thank this.

Chinatown's advice is the best. Get enough cash to drive the truck back to the yard without a load. Find another employer ASAP, even before you drop off the truck. Any decent company will empathize and not care about your current employer and respect you more if you tell them you are driving the truck back on your dime.

Doing anything else might inadvertently screw you. He could be vindictive if you do by reporting an abandonment on your DACd etc.

You didn't answer my question, what did the contract say?

We are all assuming you are running under 1099, so ...

As far as the argument between @buddyd157 and @Ragman54 , a lot depends on your state labor & contract laws.

Oklahoma, for example, says that any language in a contract that is illegal is void. It also says that employers have 3 business days (IIRC) past the regular payday to pay wages due. And if no regular pay schedule is made, then monthly paydays are assumed, I think on the 1st of every month.

Then also consider that 99% of 1099 trucking jobs are considered regular W2 jobs by the IRS.

Can you be a little more clear on what that even means?

Are you saying it doesn't have commercial license plates or it doesn't have a DOT number on it? Is that what you mean?

No commercial insurance, IFTA or anything. They’re bootleggers. If that’s correct, his lack of pay is the least of his worries.

I’d wipe the steering wheel, door handle, windows, interior, and greydog my arse to the house.

    That's a fact!

Six, I've talked to a few scale masters and DOT are on the look out for these kinda outfits. They are getting wise to them and they're catching them left and right. I applaud them on every one they catch.
