    Actually, my final rank was USAF SSgt. I have been involved in several lawsuits over the last 10 or so years. These things are not that easy.

    I would say have the prescription bottles and the Physicians office information clearly on them. I say this because if you are ever not responsive emergency people can at least try to contact home. As far as the note goes I think having any meds that might cause a positive on a drug screen a driver should make sure the medical examiner has given an OK to take and they are listed on the long form.

    When the word "Discovery" is sprouted around a lawsuit situation (Ive been sued twice and both were taken care of, one settled and the other laughed out before it got to trial) it means you are with your lawyer and facing the opponent across the table with his or her lawyers. A clerk is there to take down every word in writing shorthand transcript etc.

    The one person who blew past the company gaurds telling him that he cannot enter now until I am docked with my 18 wheeler in Baltimore was late to work for the third time. He went ahead and blew past and into my turf and allowed his car to be hit by my right hand drives denting the door and allowing him to cry make pain stop. Ambulance came.

    At the Discovery day prior to court trial, my lawyer reduced this plaintiff to being discredited because the official diagnoses at the ER was shoulder sprain and they cut him loose in a few hours with pain and relaxer medicine for a couple of days.

    Keeping in mind this was mid 80's long before we exist in a world where you cannot fill a single pain pill, xanax class pill or a muscle relaxer pill without being recorded into the PMB etc. This man was running around filling a dozen different pharmacies for the single prescription. Essentially doctor shopping. There were doses listed at values high enough to make me blush today recalling it. Something on the order of 120 MME daily in total night and day for each. Big pills too.

    Anyway that was the limit of my experiences in being sued and what Discovery really means. And my job? I continued on trucking. That was not a accident that mattered really once discovery was finished.

    If it was a accident today? I probably would be dismissed as that worker would have been fired. The PMB would ensure that this person would not have been able to fill that many prescriptions in a hurry. I myself keep a driver on hand most of each month, I allow myself a week off from any medicine so I can clear the head and actually think and drive errands if needed. I would hate to be driving and get into a accident to face discovery or lawsuiting later. That's where my coverage meant for that kind of a problem comes in.

    I forgot about the hassle the driver may have in Civil Court. Where they go after the company/driver for cash. Your example is a good one where this guy wasted your time to go into a deposition. I'll bet that cost you some bucks.

    However, when I speak of legal action I was referring to cases where there is a fatality involved and the driver is going to court. The outcome could very well mean jail time. I was involved in a two fatality accident in the early 90's out in the desert going to Laughlin NV where this Van came out around me to pass me and his boss driving the other way went off the road into the dirt then caught the pavement and came back and hit the VAN. They hit right beside my trailer and the Van flew up with the passenger side front tire coming down shaving my tank. I'm loaded with 9000 gallons of gasoline and did not spill a drop. One driver in the VAN and the other in a pick-up both died. Now that accident was clearly defined on who was the cause so it did not go to any court. But if a driver is involved in a bad accident depending on what the inspections find, he may just end up in a Criminal Case. And you can bet the DA is going to use the medication against the drier. Remember the driver that hit Tracy the comic. So whatever you do it's best to let everyone know and don't listen to drivers tell you to hide it.

    The real moral of the story, in all honesty, is just list the medications right from the start. @GasHauler is right about the criminal-civil case situation. I remember a case from way back in the 70s when a (drunk) trucker ran over and killed a young girl out on I 85 near Commerce Georgia. The driver knew civil cases was coming and got the Judge to accept nolo pleas in the first criminal case.

    If you are taking it as a mood stabilizer then you can continue taking it and have your prescribing doctor send over documentation. All I need to see if confirmation of something besides a seizure disorder.

    The new login.gov is a national database that takes affect in January of next year. DUI, drug issues and everything will become federally regulated across all borders. They will know if you have been prescribed any medications.

    Interesting, so you are also a prescribing physician? Be careful stating those things on public forums. They will get a lawsuit slapped on you quicker than you can blink. You cannot discriminate for any mental issue that is under control with medications. Called the ADA (which is federally regulated), might wanna look it up if you do the hiring. HUGE NO NO!!!

    Preach sister!! I am a DOT Federal Medical Examiner and I would pass you. No one can use that against you as you are covered under ADA or presume they can override ADA & FMSCA federal guidelines. Tell the truth and I wouldn't let anyone I know work for people that openly state those kinds of things.
