My Company owes me 2 paychecks and can't fund fuel to get me home

    Don't be vindictive, manage the situation as best as you can. Only you know the owner and the full situation. Let me, however, tell you a story about a small trucking company in Northeast Georgia that went out of business about 12 years ago. Everything was fine. Money was there and the drivers were paid well and the checks did not bounce. The owner and his wife both were ex truckers, in fact, this is how they met many years before. I knew this man and had for many years. He made a bad investment/business decision and when the (margin call) came he had to pay up. The man tried for almost 3 days to secure funding to operate. In the end, all he could do was get his drivers home. He lost everything and last I heard is living in an assisted living facility near Atlanta. I would say 99% of the time when a carrier goes belly up they were running crooked borrowing from Peter to pay Paul, in some cases though it's just innocent mistakes. By the time the equipment is being recovered the owners are long gone and it is the banks and finance companies that are paying to get the equipment home. Bottom line, go after the owner another way, please don't get vindictive against the recovery company!.

    I agree, off the table. However, though it is still part of the driver's history they walked away from a truck, a dang good reason I grant. I council total honesty and let any new carrier see there was a (VERY GOOD) reason for the actions you took. If you don't, and a later entry is made on DAC this (might) be seen during the yearly review. I have seen drivers fired because of things discovered during the yearly review that was not made part of the initial application.

    Thanks a lot guys. Completely agreed on all this. I am not going to drive that truck anywhere until I am perfectly happy cashwise. IF he makes the cash right, I shall stay with the company through completion of a full 90 days of working relationship, which satisfies the requirements for one of the recruiters.

    If there is no / not enough cash, then I leave the truck keys with the fuel desk here at the Flying JJ. I'll be home tonight and lodging a complaint with the Federal DOL

    before dropping the keys at the TS - I would called the local police station and advise them of the situation and your intentions write down the badge number of the person you are speaking with. If those keys and truck goes missing, you may find yourself subject to a warrant (hijacking, theft etc.).
    different laws may apply in different countries/states/ provinces but always CYA - right ?

    You took the words out of my mouth. I was going to delve into this subject but decided enough smoke was already in the room. However, this is true.

    TO THE OP::
    YOU are responsible for that truck and if it comes up missing YOU can be criminally cited for stealing it. This is why I have counseled you to secure it before you leave. Leaving it parked at a fishhook with the keys left at the fuel desk is not securing the truck.

    Before you make any decisions, check the registration on the truck. If there's a lienholder your boss might be in arrears on payment and the lienholder will want to know where the truck is.
    If the lienholder needs the truck brought somewhere you might have your ride. If not, the lienholder can tell you what to do with the keys and paperwork and such.
    Whatever you do, don't put any more of your own money into this deal.
