    HAZMAT Endorsement Threat Assessment Program
    Interim Criminal Disqualifiers

    The following list was specifically designed to identify disqualifying crimes that pose a potential threat to the nation's transportation network. The list is comparable to assessment standards applied to millions of airport and airline employees. These crimes are only disqualifying if they are considered felonies in the appropriate jurisdiction, civilian or military.
    You are disqualified from holding an HME if convicted or found not guilty by reason of insanity within the previous 7 years or were released from prison in the last 5 years for any of the following crimes:
    May be Eligible for Waiver/Appeal

    • Unlawful entry into a seaport
    • Assault with intent to murder
    • Kidnapping or hostage taking
    • Rape or aggravated sexual abuse
    • Unlawful possession, use, sale, manufacture, purchase, distribution, receipt, transfer, shipping, transporting, delivery, import, export of, or dealing in a firearm or other weapon
    • Extortion
    • Dishonesty, fraud, or misrepresentation, including identity fraud
    • Bribery
    • Smuggling
    • Immigration violations
    • Violations of the Racketeer Influenced and Corrupt Organizations Act (RICO) under 18 U.S.C. 1961, or a comparable State law, other than any permanent disqualifying offenses
    • Robbery
    • Distribution of, intent to distribute, or importation of a controlled substance
    • Arson
    • Conspiracy or attempt to commit any of these crimes
    Permanent Criminal Disqualifiers

    You are permanently disqualified from holding an HME on a state-issued CDL if convicted or found not guilty by reason of insanity for any of the following crimes:
    Not Eligible for Waiver

    • Espionage
    • Sedition
    • Treason
    • A crime listed in 18 U.S.C. Chapter 113B - Terrorism, or a State law that is comparable

    Yes, but he also does NOT drive for the company in the original post. Not knowing where your partner is from, and the last renewal of his CDL, it's highly possible he holds a valid haz-mat. BG checks have only been around a few years.

    This was the first year I had to submit to a BG check for a hazmat....ever.

    Felons are not completely discounted from holding a Haz-Mat. Hell, jaywalking could lead to a felony charge in some jurisdictions.

    However, there are felons who will find it very difficult to obtain a haz-mat. And there are felons who will not be renewed in the future.

    we went to school together he has only had his CDL for 5 months we even did the backround check on same day and DOT physical and he got his endorsement

    That depends on the amount that he had in posession. They probably bumped it back so it wouldn't be a felony. If it was a large amount he wouldn't have been their to tell you about it unless he decided to RAT everybody out. In that case I would stay clear of him. As far as posession it goes by the amount of the substance.

    Holy crap !!! You're buddy better keep his job.

    How old is that charge ??? I've watched guys get booted from orientation of ANY charge directly related to drugs.

    I'd say your buddy made out really good, all around. And should count himself lucky.
