I just got a random DOT level 1 full inspection in California on I15 and I did not get a ticket or OOS but I got a violation for "other brake violation 396.3A1B CLEVIS NUT BACKED OFF" Is there a way I can fight this on dataQ so it does not go on my record? It is not a pre trip item (according to officer that did inspection) nothing else was found wrong with trailer or truck.
The part is called a "jam nut" or "clevis nut" it was screwed forward about 1.5 - 2 inches the nut was not damaged, broken, or loose. Just positioned forward.

Did he make you snug it up before you were able to roll? You are talking about the one on the road coming out of the brake chamber right? I don't know as far as fighting it, I'm sure someone will know.

I dont know but 1, yes its part of the pre-trip, but then so is everything else. But I dont think its that major. 2 no its part of your pre-trip or lack there of. The point is to get you to remember to check it, I am sure you will.

It's a minor thing. Nothing really to worry about.
The only person who can fight this infraction for you is your safety director, and all he can do is write a letter challenging the infraction. After he does that CHP will simply ignore his letter and the matter will never come up again.
Over time, and should you receive a clean level one inspection, your CSA points will fall to zero again.
So, just pay attention to your equipment and maybe have one of your company's shop mechanics look at your truck and trailer whenever you are in the yard.FlaSwampRat and Truckdrivingnew Thank this. -
The dot officer said it's not part of pre trip, but he can be wrong. The part was not damaged, loose, or broken I honestly just dont know where the nut is supposed to be located (1 inch back 2 inches forward) I'm not a mechanic

I will keep a better eye out for the clevis nut now it's just hard to see it because you need to get between axels under trailer. Just worried this will hurt my chances of going local in future. -
You don’t get CSA points, your company does. Fighting something this minor is useless. You admitted it was loose, so there’s nothing really to contest. Every part of the truck and trailer is included in the pretrip, it’s up to you to make sure everything is as it should be before you take off in the morning. Sometimes that includes putting on some coveralls and getting under your truck and trailer.
