There is a lot of information left out of the situation, for the benefit of the OP defendant don't say anything more in ANY forum. That said, my sister who IS a California attorney has successfully defended a CDL driver who was charged with a similar DUI. The driver was in a parked car on the freeway in or around Ontario.
The OP has not mentioned counsel, likely the public defender, that is the person and place to talk through the legal implication of the case. ANY and all matters regarding this should be phrased as hypothetical situations NOT actual aspects of this case, understand.

I've heard of being charged with DUI in Ca. for just standing next to the car while intoxicated.
Don't know how it turned out.
There should be some kind of legal help available. Even in backward SD. There is a law office that helps when faced with financial ruin.FlaSwampRat Thanks this. -

Not necessarily. In many states dui/dwi etc is in their criminal code not their traffic or hwy regulatory codes. This means dui/dwi is a criminal, not a traffic violation. As you know criminal violations can occur on both public or private property.faux_maestro and FlaSwampRat Thank this.

Heck, back when I was younger in Ft. Worth, Texas there was a guy charged for a DUI. He was drunk yes. Thing is, he was working on his boat (the on board engine was apart) in his driveway of his house 30+ miles from the closest lake.

All this drinking and driving crap was not an issue until the 80s.
I've been told more times than I can remember the old routine from troopers being... "Your drunk go straight home." "I will come by in the morning to make sure your ok."
