Dispatches not legally possible. Do them anyway?

    See, this is why I have F U money in my checking account and a credit card with a high limit.

    For situations like this.

    Do what you gotta do to get to your mothers funeral OP. I'm sorry for your loss.

    I'm intrastate and have a pole barn.... I bring my tractor home (and often trailer, loaded or not) legally. They probably drone my house; idc. Legal to be here. I've not been OTR for um...ten years?!? Give or take.... IIRC. In the winter, I 'll drop the trailer on my gravel / concrete pad, and park the tractor inside, and plug her up to the box. Yep, got that too. I get it that many people don't .... i SURE put in my years OTR, and my years BEFORE that, driving Vactors. If my mom was ill, I'd bring Bessie home, and be here, and no worse for wear. AND have my J.O.B. ... I've got safety on speed dial; Kim never says no, because I DO MY job.

    Thank you to everyone who replied. This argument with dispatch went on from Friday night until this morning. I finally got them to agree to let me drop it for relay after standing my ground after getting a message rudely instructing me like I'm a #### slave to "go get the load or you will be written up for failed load" after my 20th message that simply said 'I've declined this load several times because it cannot legally be done within HOS regulation limits." (I kept replying just that, and they kept replying refusing my denial to accept the load).

    So I went and got the empty and went to get loaded. When I got there the shipping clerk couldn't find the load for the number I was given because they didn't give me the reference number. When the clerk finally found the load I was supposed to be picking up it turns out the load was picked up before I was scheduled to get it yesterday anyway! By a different carrier.

    I appreciate all of the replies, it's a great community here! My real question I was trying to get an answer and the info for is: What do we do in this situation? Isn't there somewhere to report a company (like to the FMCSA, which I have called and left a message to) who continually violates FMCSA laws and regulations, bullies us, treats us like pieces of crap, etc?

    Where is there to file a complaint with that will protect us and slap these a-holes around like they need to be with consequences for their acts of violating federal laws and regulations? Laws have consequences if they're violated. Are companies exempt from the laws and consequences? Who enforces FMCSA rules/laws/regulations?

    Me personally I would tell them I would do it but its highly likely to be late. Now if they decide to give you a service failure I would dispute that.

    Document everything you can about them asking you to violate the regs. Take pictures of the messages and save any texts. More is better. Then call the FMCSA.

    Gotta love an industry where simply not being on time has generated new terminology..service failure.
    Do you give the term to your doctor or dds because you waited?
    How bout a date that's 15 minutes late to the restaurant, make her reschedule?
    The whole JIT concept has gone to far ...
    I mean that the load of pampers or frozen pizzas that arrives at the appointed time and can't be unloaded. Does your carrier give them a "service failure?"
    Back in the day you were just late.

    Op, no one gets bullied unless they want to.

    Sorry but you have the final say, no one else. The law andnregs say that, just like they say if you drive an unsafe truck, and you don't say no, it is now your problem if you get caught.

    I would not have let this go passed an hour, I would have quit if they insisted on me taking a load.

    Why would you even bother arguing with a dispatcher? You over them up the chain of command until you get to someone who makes decisions.

    Jesus Ive had my company dh me almost 400mi home because it was Friday. If I had a death or family emergency, it wouldn't even be a question.

    I will say this though, declining loads solely because "My HOS wont allow me to make a delivery" isnt right. You take the load, you run your hours and plan where you're going to stop for your break. If there is a problem at that point, you make it known that you did what you are legally allowed, they can reschedule the drop off, especially if its a mega carrier. Id bet this attitude of "I CAN'T because" is what caused your current situation. If you had been more of a "I'll do what I CAN" driver, you'd have already been on your way home. Sorry to be harsh, but its my take away from your posts.
