Running illegal

    My boss is trying to make me run illegal, and I do not like it. He is a small O/O with 2 trucks. So far he has a perfect safety rating. His trucks are old and have some problems. According to him, he always follows the 11 hour rule, but not the 14, because he cannot control how long it takes at the "shipper." The trip he has me running is at least 37.25 hours if nothing goes wrong. The last trip took about 45 hours, but I made it "legally", at least according to my log book. So if I leave at 0500 Thursday, I am expected to be back by 1900 on Friday. The trip is about 1050 miles. I made a "test" log to see what would happen under the best case scenario, logging it legally: 10 Hours SB or off duty; 19.75 Hours Driving; 7.5 Hours On Duty. There are a lot of stops on this trip, many of them taking over 2-3 hours. This does not allow for any stopping for restroom breaks or meals, only a 10 hour break. Again, this is best case, not likely to happen this way. I want to keep my job, but I also want to come home to my family, as well as keep the general motoring public safe. I am wondering what I should do. Should I pull into a weigh station with logs that are not legal, and ask to be inspected? I just want to do what is right, and still have a job. Any advice would be greatly appreciated.

    Your the one that is in control of the rig! If the stops equal 2-3hrs then no it can not be done legally.....If some one get hurts who will be at fault!! The DRIVER !!:biggrin_25521:

    The whole trip took 45 hours. I am a car hauler, and may make 4 stops, possibly even more. Each stop takes at least an hour sometimes as much as 3 hours or more. It took me over an hour the other day to find just 1 car at an auction. Not to mention the time to get through security, load it, and get it secured.

    I am positive that what I said is not legal. What I am asking for is how to get my bosses attention without getting fired. I do not fuel on my trips, if I do it is at the beginning or end. I do not travel toll roads. If there are any documents in my truck that would indicate when or where I pick up or drop a load, you can bet your butt that my log book will reflect that. I pay for everything in cash. I am trying to figure this all out. With the economy the way it is, there are not hundreds of trucking companies knocking at my door.

    10 hrs thats all you can break.Dont drink anything, dont eat cause eventually will have to go to the restroom.You could combine a dinner break into the 10 hr break.Eat and goto bed.Sleep get up early and eat again.I would say not do.You have to get your boss to understand you are a human being.not a robot behind the wheel.The run is a push.Going by yeti1 and the figures given.Not possible to do the run.Your boss can not legally ask you to do this.Also, can not fire you if you refuse but will probably do it anyway.I would log it as you do it, if you get inspected, make sure you have proof you are being forced to run illegal (a qaulcom messgae, a cell phone conversation on tape).This way they shut you down but hopefully not write a fine.You can play the game drive legal to when you need to stop.Stop at a scale house ask to be shut down and explain why and ask to remain annomymous.Then the boss will get in trouble and you are pretty nuch out of it.meanwhile unless your making millions ayear.Find a different boss.There are alot of companies that want you to run legal, period.:biggrin_25525:

    We do not have quallcom, but I will buy a voice recorder. This is some of the finest advice I have ever recieved. So if I ask to be shut down, are you sure that I will not get a fine?

    I did not even mention the fact that this is only possible if the truck was already loaded the truck the day before...

    The old timers might recall Gunther. There was a fatality accident involving one of their drivers and in the investigation, it was discoverd that the owners repeatedly demanded that their drivers violated HOS rules. Well, long story short, the owners were ordered to shut the company down, turn in their operating authority, ordered to never get back into trucking and, if I recall correctly, Mark Gunther was sentenced to 18 months for his actions.
    Tell your boss to look this up and then ask your boss if he really wants you to run that load illegally now!
