I hurt a kid close to my age in a street fight which was not charged or prosecuted as a teen. However the Law was interested to see if there was a interest in doing so against me a very long time ago. The entire situation was a bad day all around. Kid was fine after a few weeks but the best solution was to change the dynamics of the other children involved in that particular problem.
I have been through some serious background checks several times in life and there is nothing there to speak of. The one good thing about that horrible day was a permanent change in who to take on and why. So each of the fights in the school for example usually had me on the defensive waiting for the bully to throw first which by school rules got him punished and suspended, even if he came off medically damaged for worse and wear. (Never pick on church mice. You will be eaten up lol)
However one day when I was 18, the state school for the deaf handed me a large folder and said my records and life is contained in that folder. Do I want to keep it or destroy it?
I had it incinerated. The State kept a few goodies in the archives which is fine with me but the rest of it was incinerated. Why? because it was totally just school stuff. Boring actually. The one paper that mattered was the transcript which I got when I went to college. Everything else was just disposible and had no value in future life.

No I have a clean record. I am applying for a company and had to put previous experience down and I said I was driving a class B and it said if you were subjected to fmcsa tests to check those off which I did because all companies have to follow those rules I just was wondering if a third party backround will look to see if I really took the fmcsa drug test and dot and all that for the company I didnt really work for or would they just call the owner and verify that with them only or will they also call DOT and Fmcsax1Heavy Thanks this.

If I was a fleet, I would probably examine your driving etc. I am less concerned with your past with the exception of accidents etc than I am with your actual experience. IF you can handle the truck, then alls well. You should have work anywhere you want after a certain amount of time in this industry. Maybe even some golden ticket loads that pays a lot for very little effort.

As pursuant to CFR 382.413, the undersigned states that he/she has NOT tested POSITIVE for Controlled Substance and/or Blood Alcohol percentage over 0.04% within the past thirty-six (36) months at any previous motor carrier or prospective motor carrier; furthermore, the prospective independent contractor has registered with the FCMSA Drug and Alcohol Clearing house..
The undersigned also states that he/she has not refused Controlled Substance and/or Alcohol Testing, by any former or potential motor carrier within thirty-six (36) months prior to this dated affidavit.
This declaration is made to the best of my knowledge and recollection.

A form like this is part of most applications, note it only pertains to motor carriers.
The DOT ls looking for an unbroken chain of employment history back 36 months. that covers the time the prospective motor carrier is supposed to check for drug and alcohol violations and is protected by the DOT for acting on the information received.
Divers with more than 3 years of driving history are supposed to supply only the DOT employers back another seven years
With the new drug and alcohol clearing house, carriers must still check drug and alcohol history until the database is over three years old.x1Heavy Thanks this.
