should an employer continue to let you drive if you get positive test results for amphetimines ,also what should someone do if the employer told you that amphetemines werent cs,you get in wreck sevral months later your test results the same,,,,,,,,,,,,,,,,would the employer be wrong for continue your driving what is the employers responabilty to remove you from driving and should it be reported to dot when it was a pre employment drug test,1st time

Yes if you test positive they hold the right to let you go, DOT on the other hand would rather pull your card... what do you mean by "cs"? I think, not sure pn this but depending on what you test + for on weather they need to report you. Then Fire you.

You shouldnt be alowed behind the wheel if you tested positive on a drug screen. Also dont expect an answer right away around here, alot of people are out trucking.

cs (controlled substance} u miss understood some of the question, in reply to dont exspect many answers because most truckers r working ,i am not stupid, yes i agree that u shouls not be behind the wheel, the deal with the questions is i have a close family member that drives truck for a man that has 12 trucks,it was about 2 months before he sent this person for pre employment drug screen, the results went to employer,the employer told them the results were neg. later he was old the only thing that showed up was amphetimines and he use to take it,then when the wreck happened the results showed a positive for amphetimines,thats when this person relized,, my question is this the employer should have fired personand give person the info on SAP programs instead of working this person and running them until the wreck happened,i know the person is also responsible but no one is perfect,also as far as i know nothing has been sent to dot about positive test,i feel like the employer is part to blame if he would have taken this person out of the truck and went uy dot law driver couldnt have gone back driving therefore wreck would not have happened

The rules are clear on this. At any time that a driver tests positive for any illegal substance, the driver is to be removed from driving immediately.
A company that would allow a driver to continue driving once notified of a positive test result for illegal substances, is in violation of the regulations. The fines are severe, if this were to be discovered.
I suppose that there are rogue employers out there, who are so desperate for drivers, that they would trash any record of a positive test result and allow the driver to carry on, but they'd still be caught at some point, because the records exist that would nail them to the wall. -

so how would the driver go about reporting employer and start getting things in order?? the wreck he was involved in was 1 vehicle only ,fell asleep ,didnt get ticket ,,,,,,,,,,yes i would like to find out how to go about reporting to dot ,because employer has asked driver is he ready to go back to work, without any actions taken about the 2 positive test results in approx 6 months,actually the employer has never really even disscussed either result,,,,,,,would also like to find good lawyer but dont know any niether does driver

there is missing info here. I think you are sticking your nose where it doesn't belong. it's not your business. This is between the driver and company not you. as you have already been told here Company had every right to fire him. consider him lucky , if d.o.t. would have caught him he would have lost everything with little hope of getting a job any time soon.
