    It's like that one other douche bag who goes thru the border patrol check point and refuses to say if he's an American citizen and they end up bashing his window to drag him out lmao

    Correct. I'm explaining where the legal line is. You can't refuse inspection. It comes with your CDL and permits. Refusal to comply results in those privileges being taken away. I would charge the driver with the lesser charge of failure to comply with a lawful order and put his truck out of service. The sergeant in that video was reaching too high. I'd make the driver post a bond and when he doesn't show up to court, suspend his license. There's no fighting the dreaded roadside inspection with maybe one exception. If you're continually harassed by the same inspector repeatedly over time you have cause for legal action. Also keep in mind, not all officers are DOT certified, so a regular street cop can't (and won't) inspect your truck except for out lights, missing mirrors, plates or obvious mechanical issues also common to any other motor vehicle (although a phone call can be made to have one come if you turn on the tude). True, some of those DOT guys totally give the whole law enforcement community a bad rap. The unarmed ones at the scales with a little power are the worst. I haul cars and was told I was hauling hazmat and needed placards and a hazmat endorsement by one of those guys. Too bad he didn't write the ticket. I would have had some fun with that one in court after having a chat with his sergeant.

    In other words, both were wrong in the video and clearly involved in a testosterone saturated pissin' match.

    Actually, if you have logged sleeper berth time in your log book and the officer wants to push the issue, he can check to ensure that your sleeper meets the regulatory standards of
    § 393.76 ...and to do that, he needs to see inside to check the size, exits, ventilation, mattress, bedding, restraints, etc...and he can do all of that without a warrant, without probable cause, and without your consent. He is merely ensuring compliance with the regulations during a roadside inspection, same as any other regulation in that little green book.
