    Actually you have to be tested within 2hrs of the incident. Waiting for that many hours can be seen as an issue.

    Looked it up in the FMCSR. Is on page 232-234 *382.303 "Post-accident Testing" for the requirements for post-accident/crash testing. the "within 2hrs" I mentioned is for the alcohol testing. the other testing can be as soon as practicable.

    I am surprised that this driver is not up to speed on the laws and regulations. General rule of thumb is ignorance is not an excuse for not knowing. We each must be up to date on these requirements on a regular basis, in order to be safe and legal.
