Yes, technically, you should be "safe" and not struck if you are stopped on the right side of the fog line, however in the real world there are realistic misfortunes that do happen, and sometimes the answer is not/never known. Was the truck driver sleepy or momentarily unattentive? Possible. Was he having a medical problem (heart attack, cough/sneezing attack, sudden intense pain, etc, etc). Possible. We'll probably never know.

Anytime you have a vehicle at a dead stop within the CLOSE proximity of traffic doing 65-70mph, there is a certain risk of bad things happening. Mistakes only have a margin of inches, not yards or more. The minivan driver may be "legally" right in where he stopped, but it is also his responsibility to also use his head and stop his vehicle in the safest place, considering the setting & conditions (unlit highway, darkness of night, etc). How much would it have taken to drive shortly further to a much safer stopping area (exit ramp or rest stop)??
Since he & the son were struck/killed, it it quite possible they were on the traffic side of the stopped minivan! Possibly even in the traffic lane, or at minimum, literally standing on the fog line. Too soon to tell, just yet, given the info.

Well just today on I-26 near Columbia, SC. Car pulled on shoulder with only his right turn signal on. Tractor/Container trailer driver in left lane next to me. Tractor trailer driver starts swerving into my lane as I approach the car. I basically start throwing up my left arm in disgust at this driver as he's basically forcing me onto the shoulder with his bone headed driving. Thankfully he pulled his head out of his ### before I was forced to hard brake.

"a 7-year-old family member became ill"

Ya know I've noticed a lot of more instances of people doubled over and puking their guts out on the side of the interstates this summer.
