Catching up your log book

    My boss says i do not have to start my log book at the beginning of my day he says if i get pulled over they have to let me catch it up. That would mean logging for that day but if you do not start your log when you start your day and you get to your destination you could log anything you want so you could get up at any hour the next day for your return and i think that is what he is telling me he wants me to lie. I always log so when he ask i tell him i started my log when i left that way i can not change it. He wants me back earlier so i can make more local runs etc. the next day. Please tell me legally dont you have to at least start your log and then if you get pulled over they will let you catch it up or you do not even have to start your log and they will let you catch it up. Which is correct so i can tell him because he says the law is you do not even have to start it each day and they have to let you catch up. Please some one tell me what the fine is if he is wrong so i can tell him. I would like to quit but i will lose everything i own. Why is being honest so hard!

    You need to update your log every time you change your duty status. The last thing you want to tell DOT is give me time to update my log, I am not sure on the exact wording of the law of how much time they are "supposed" to give you because I have heard many different things, but all I know is, if you try and pull that card, be prepared to have every inch of your log book and truck to be inspected.

    They give you no time to update your log.

    At all of my inspections, I have been met at the window and logbook requested, then told to park.

    • Drivers may be placed out-of-service (shut down) at roadside until the driver has accumulated enough off-duty time to be back in compliance;
    • State and local enforcement officials may assess fines;
    • FMCSA may levy civil penalties on driver or carrier, ranging from $1,000 to $11,000 per violation depending on severity;
    • The carrier's safety rating can be downgraded for a pattern of violations; and
    • Federal criminal penalties can be brought against carriers who knowingly and willfully allow or require HOS violations, or drivers who knowingly and willfully violate the HOS regulations.

    There is a specific section in the rules that states the DOT will give you 15 minutes to update your log book, and that is what your boss is referring to. But the bad news is that he is taking it out of context, you must keep your log current to the last change of duty status. The 15 minutes is to bring you up to date on a current day if you were not current (but eligible for a ticket for that!) to avoid being put completely out of service for hours.

    You will still receive a ticket for the logbook being not current.

    Can you post the reg for that?

    Never heard of that one. I have seen an officer tell drivers to update when their RODS is started prior to midnight and current to then an inspection after midnight.

    Never seen a regulation saying any time line for doing so.

    my last inspection went off without a hitch. hit the scale, the officer threw the red light on me. this was in NC. he comes out, asks for my log book and says park and bring the manifest, registration etc inside.

    i walk in, he is done with the log book, it is sitting on the counter. he informs me that as soon as the paper prints, i need to sign his copy and i get mine and i am free to be on my way. i picked up my log book, and asked him for the town name, then said 15 minutes sound good for you for a DOT inspection? he looks at me and says yes and i made the entry in the log book right there in front of him.

    remember that next time you get asked for your book. if your book is current to the last change of duty status, you will be on line 3, driving. as soon as you hand it over, you cant make a change until they give it back so that is why i do that as soon as they hand the book back. dont be scared to ask or make the change. they can not do anything to you for that.

    (3) Exception. A driver failing only to have possession of a record of duty status current on the day of examination and the prior day, but has completed records of duty status up to that time (previous 6 days), will be given the opportunity to make the duty status record current. (4) No driver shall drive a CMV in violation of §385.811(d) of this chapter.


    He's right that keeps you from being placed out of service but not avoiding the ticket.
