No state is allowed to require an employer to take more than 40% of your working income or the amount set by the court which ever is less. Working income is after taxes; however, you are obligated to pay the entire amount. So you have a bad week, your employer takes 40% you send in the difference.
Paying through the state through payroll deductions is better. If your ex gets the payment late it's on the state and your employer not you... Employers are obligated by law to obey court ordered child support payments through payroll. No court order no deductions... They are also required to make the payments to the state in a timely manner, but only to the 40%. -
Funny but my paperwork from the Child Support Enforcement Agency in Ohio clearly reads 66% after taxes can be garnished. If I owe any arrears, they can take an additional 5%!!!

I am not a lawyer, but I was an employer with employees in California, Washington, Oregon and Idaho.
In all four of those states, a withholding order usually showed up within 30 days of my having paid withholding on a new employee. (Withholdings were paid on the 5th of the month following withholding)
The order was plain and simple. I must withhold $xxx amount of the FIRST dollars netted after Fed, State tax, FICA, FUDA and in CA SDI. Before 401K deductions or medical account withholdings.
So if the amount I was to withhold was greater than the net amount owed to an employee, they did not get a check.
I was allowed to split the withholding in half if the employee was paid bi weekly or in quarters if paid weekly. In the four months each year where there was an extra pay period, nothing was withheld.
If I failed to withhold as required on the order, I (my company) could be held liable for the funds not withheld.
So if I felt sorry for an employee, gave him a hundred dollars and did not withhold all the child support, (and the employee left), my company would be liable for that money.
Yes, the states audited us each year regarding withholdings, along with the sales tax audits.
I can't say anything about other states, but these four REQUIRE employers to withhold. Courts don't allow you to pay separately, outside of employers anymore in most cases.mtnMoma Thanks this. -
