Citations, Warnings, Tickets

    I got stopped today for a level 1 inspection. I haul hazmat in a tanker and drive a day cab. We haul different products and use many different trailers. On my first load of the day, the only papers we are given is our manifest that tells us where to load etc. We don't have previous bills of lading, but might have a washout ticket if the trailer was cleaned out. It is a placarded trailer. I received an "out of service fine citation" for not having a previous bill of lading or washout ticket. I was a half mile from where I was supposed to load and the officer told me I could continue on. I get the paperwork thing, but what affect does this have on my CDL and what is the difference between a citation, ticket, or warning and how they affect the driver? Thank you for any replies.

    A citation and ticket are the same thing.

    A warning is a bit different because most LEO's don't actually give out warnings, but yet they call it a warning. What happens is the officer writes up a CVSA inspection report and notes the violation on the inspection. They will then not write a citation and call it a warning. Any violation on an inspection report is a violation. It puts points on the companies CSA score and is on the drivers PSP report.
    Now if you got a true warning, i.e no inspection report, then no harm, no foul.

    As to the damage to your CDL, it depends on if you got a citation, just a cvsa violation, or a true warning.
    Did you get paperwork and what for? Was it just the OOS? If so, I'll let a hazmat answer, but I can't see it being that big a deal (or the company would not allow the simple paperwork issue to happen)

    Anytime you pull a chemical tanker, you need to have either a washout slip or a copy of the last bill of lading showing the last contained product. Hazmat and placarded or not. Everytime. You will have this on your PSP and your company on their CSA score. The OOS part is the worst part of it.
    Ok a citation is a ticket, although some times you may get what they cal a "Fix it " ticket" where you just have to fix it and get it signed off. Anything written as a violation on an inspection form will hit the PSP, CSA. Many times you think you are getting a break with just a warning but you can fight a citation in court. You cannot fight a warning. You can file what is called a DataQ with the FMCSA if you think the inspector/cop was wrong and may get a violation reversed. Don't hole your breath on that one though.
    As far as an effect on your CDL, do good pre-trips and try to make sure anything you pull will pass an inspection. otherwise don't move it. And in tanker, especially when placarded, make double sure any paperwork, permits etc are in order and correct. When the law sees those placards they don't see the UN number. They see dollar signs.

    I received 3 warnings in 2016 and they all hit my CDL and put points on my companys score.
    You can't fight a warning in court i tried , Laporte Indiana troopers know this trick.
